We were encouraged to file for TSGLI, which we did, and it was denied. My husband was injured on 7/31/07, but not taken to Landstuhl until 3 weeks later. When he arrived at BAMC (after 11 hours in the er) we were given the choice of whether we wanted him to be admitted as an inpatient or as outpatient- we chose the latter and the clock on his hospitalization stopped (short of the 15 days). As much as this sucks, I understand it. His unit drug its feet on getting my husband medical attention, but that's not the TSGLI people's fault.
His TBI caused him to need assistance with 4 of the 6 ADL's, but the problem is it isn't well documented (which is what they told us when they denied his claim), we were rushed out of BAMC (signed in the WTU one day, signed out the very next day) and he was given 30 days of convalescent leave and sent home.
My husband sees them denying the TSGLI as just the first step in a long process that is going to screw him over every chance it gets. It really isn't about the money, as crazy as that sounds. He wants to appeal. I really don't think it will do any good, but I want to help. Is there anything we could do/do differently for the appeal given the situation?

I'm new here as well and I am very glad I found this site! My husband was MedEvac home in August from Afghanistan due to an IED injury. To make a long story short he now suffers from TBI, PTSD, and a spine injury. Our lives have completely changed since the injury. I literally have to lift my now 215 pound husband into bed every night. I need to sit in the bathroom with our 20 month old son while he showers because he has fell when he is in there. I had to quit my job because he cannot get of out bed usually 5 days out of the week and I need to be home to make sure he takes his meds, eat, take him to his Drs appts. etc. We live in base housing and since they wont change our blinds I have blankets covering every window of the house because the light coming through is too strong for him. The only thing wounded warrior ever offered to help us with was to give us curtains for our blinds as long as I got quoted on the price (which I would have to install myself.) All of this has taken a toll on us, especially since I had to quit my job, financially and mentally. My husbands Neurologist will not sign his TSGLI paperwork because she says he does not qualify for it. I just want to know from someone who is going through what I am... is this true? Any help would be very much appreciated!
 
It's not your doctors job to determine eligibility. The main components of eligibility in his case are his ability to conduct activities of daily living. The rules have changed somewhat regarding *proof* and I'm no longer verse in that so hopefully what Jason provided will provide what you need. I do seem to recall about the need to keep a daily log of sorts. Also, you should try submitting the application through his PCM who should have a better understanding of his overall case than his neurologist. Make sure you make it EASY for the doc and have the form filled out so that all that is needed is his/her signature. Offer the doc a copy of one filled out, and one not filled out to give him/her the option. Just some suggestions. It took me over a year to get the TSGLI, but through perseverance I finally did get it.

1) Injuries caused by one of the following:
a) A mental disorder
b) A mental or physical illness or disease, (not including illness or disease caused by a pyogenic infection, biological, chemical, or radiological weapon, or accidental ingestion of a contaminated
substance.)
c) Attempted suicide
d) Self-inflicted wounds
e) Diagnostic procedures, preventive medical procedures such as inoculations, medical or surgical treatment for an illness or disease, or any complications arising from such procedures or treatment.
f) The members’ willful use of an illegal or controlled substance, unless administered or consumed on
the advice of a medical professional.
2) Injuries sustained while committing, or attempting to commit, a felony.

Can you clarify the instances of 1 E? Please let me know if I am off here: Regardless of the effects of such, and regardless of whether they followed orders or not. You are not entitled to TSGLI. Like in my case, I would not be able to file for TSGLI because it is considered preventative(Given inoculations even though I was not deployable and they did not follow doctors orders to not immunize, which subsequently aggrevate an underlying medical condition).

How's this for a situation?
I shattered my arm in Iraq back during the initial invasion. I sent copies of my medical records showing an aeromedivac to Landstuhl, surgery there, a trip to Walter Reed, and a return to Blanchfield Hospital at Campbell. A rep from the TSGLI Claims Office is asking me for paperwork showing admittance to the aforementioned facilities--something I was never given. The records I mentioned were attached to my packet. My question is: Why are these not sufficient? They are military forms, copied directly out of my medical records. They show the 15-day hospitalization required for Tier One of the "Other Traumatic Injury" section. Hell, my current doc is even familiar with how messed-up an arm is following being bolted back together and filled in the ADL section regarding inability to dress and bathe independently. I told the TSGLI office that I wasn't even trying to qualify for anything but the Tier One 15-day thing, being that I can't prove my loss of ADLs. Again: How can copies of military forms showing the injury date, surgery, transfers to hospitals and, finally, being put on convalescent leave for 30 days at Ft. Campbell NOT be sufficient documentation?!​
 
Hello everyone I am new to this forum and have a quick question. I was denied my TSGLI because and I quote "Because evidence indicates your hospitalization was not 15 days in length". I have filed a claim before and I was only in the hospital for 9 days. So this reason does not make since to me. Now my question is: How long does the appeal process take and is there a fast way to complete this claim?

How funny that serving three tours in Iraq, 2x in Balad with the whole burn pit thing and the last in Mosul and then coming home with Leukemia (terminal disease), that I don't qualify for any TSGLI coverage. I would glady take TBI or trade an appendage to rid my body of this terminal disease. So many Soldiers all of sudden coming back with Cancer and NOBODY seems to care!
 
Looks like a bunch of certified bs here considering I get denied twice for "accidental ingestion" and get denied twice,while scumbags who get in car accident that is their fault(one I knew,which was alcohol related and got 50 grand,while I got nothing) gets approved.this is bs!stage 4 to my throat from my govt is accidental ingestion from the burn pits,yet your tsgli organization denies me twice.what kind of corrupt a%% backwards organization makes rules for the people but denies them.right in the denial paperwork I got shows where I qualify.I am so pissed and so financially in debt because I have been screwed on grants,aw2.aw2 denied me because the cancer has to be "noncurable." I could use this money.I have evidence out the a^^ and tsgli still denied me,including a letter from my oncologist stating I didn't get this from the u.s. no way in hell was I supposed to get this for another 30 years.95 lymph nodes long muscle along my neck,juggler vein gone!all because of ignorant money hungry idiots trying to save time and money.200+ like us.guess u r going to deny us all huh? 3 tours here in a het unit,stage 4 I luckily survived.I look like a fkng freak because of all the crap they took out.check out"burn pit voices" on facebook.they are affiliated with the oif community on there.I wiash your comrades and yourself the best of luck.it was hell that I would've rather been in iraq for 5 years straight and not gone home than getting cancer from my govt.I use to mentor soldiers,many of them,now I am totally different and it hell with the nuerollgical damge from radiation.

I used to be a pt stud,training other soldiers to help them with their pt test,now I am completely different,always fatigued and still to this day in a state of shock. If u aren't going to go by what you have written,then u need to take it off.I have every right to be pissed along with many others.we are the silent hereosI am 115 lbs compared to 160.like to see if I qualify if I gave u some of my nuerological damage from my neck from radiation treatments I will have for several years and see if they will change how they approve people. I'm not crazy,just a normal guy put in a fkd up situation by the ppl who r suppose to take care of you.I was a leader,a mentor,a friend to many soldiers and this bs took that away from my soldiers.this is a discrace to our country.this isn't wth I was willing to give my life for,it was reserved for my comrades and my country.
 
Hello, I'd like some feedback on how long it took to hear anything on their TGSLI claim. How long was it from substitution to notification, good, bad, need more info, or paid. I'm FIGMO now and was wondering how long this was going to take.

I just found out about this I was retired some time ago. I not sure how to make a claim I do have a Purple Heart for shrapnel in left leg, plus concussion and herniated discs, and I have been diagnosed with TBI etc 16 June 2005.
My medic I saw him for the first time this past week it was a good reunion and he was asking me why I never filled out my paperwork for this because I qualify thats how I found out about this.
My wife is my caregiver through VA etc. I get CRSC I'm 100% PTSD-TBI P&T VA rating, and 60% Army retired PDRL 10% back and 50% PTSD. Does any of this help.

No because for a TBI you have to a coma and two adl's and the adl's I have because my wife is my caregiver isn't listed on there so not sure I even qualify that's more or less why I am asking on this board.

It sounds like you should apply...it is hard to guess at the facts of your situation so, any thoughts here are somewhat limited. However, as a starting point, look at the eligibility link on the webpage and the schedule of losses. It says TBI resuling in a coma AND/OR loss of 2 ADL's. That means you don't have to have a coma. Your wife being a caregiver should have nothing to do with it.

I would apply. If you don't, you definitely won't receive the TSGLI.

I'm applying, I'm worried about being so long since my injury was in 2005 my my wife my discharge was in 2007 she has been doing my adl since then it's only been recognized recently by VA I guess I'm just gonna have to send it in and find out but I have had adl issues for years. Thank you. my wife should be the one on this board she is more on top of this stuff I can't keep anything straight any more too many concussions.

Ok, After being on the phone with several different people today getting a lot accomplished I need a question answered while I put all my records together tonight I have the DA Form 199 from my original med board I don't have real proof of anything really until after I left the Army. That form and what little bit that's on there is it going to be enough to show while I was in the army I had problems? After the Army all my VA stuff shows it all and my further DA forms 199 from my second eval and my last eval it's in there but not straight forward.
I don't have Active Army med records to show my adl's and I don't think it would even be in there since in 2006 and 7 they didn't give a shit about that like they do now. I also don't have any psych records from then either not going that far back its not possible either tried so am I screwed or do I have enough supporting documents of the last several years 2 months after I was boarded in the military and my Dr says she's gonna write it up wrapping it up since the military because but it t's obvious why I was medically retired from the army but am dreaming that this is gonna work....
