DOD PDBR Results letter Today

After, 14 long months, I finally got my letter today.

TDRL: May 2000 60% Systemic Lupus 6350
VA Rating: Oct 2001 100% Systemic Lupus 6350
PEB Final: May 2004. 10% severance Systemic Lupus 6350
PDBR paper work submitted May 2012


I accept the recommendation of The Department of Defense Physical Disability Board of Review to re-characterized your separation as a disability retirement with the combined disability rating of 60% rather than 10% effective the date of your medical separation for disability with severance pay.

The re-characterization of your separation as a disability retirement will result in an adjustment to your pay providing retirement pay from the date of your original medical separation minus the amount of severance pay you were previously paid at separation.

What do I do next all input is appreciated.

We're you still rated 100% by the VA the whole time? If so, I'm not sure how they may try to recoup the severance with the VA offset pay.
 
Yes, and I was finally determined by the VA in 2009 to be 100% totally and permanent. No more re-evlauations appts and Chapter 35 benefits kicked in as well. I won't go into details about Chapter 35 benefits but they far exceed what the Army would be giving as a retired soldier. Anyway, I plan to elect to continue to received my tax free monies from the VA. In fact, when I was placed on TDRL back in 2000 and my VA rating came back in 2001, DFAS asked me did I want to continue to get the Army TDRL retirement pay or recieve pay from VA which was TAX FREE. I choose the Tax free money.

Congrats!!! I stumbled across this page looking for help. Well I was rated the same as you for the same illness in 2004 via VA for lupus and 60% tdrl and supposedly 10 % severance separation in 2008. I was wondering if I am eligible to file a claim for pdbr

Romonica1, Absolutely you should apply. Please ensure that you read the requirements carefully on the DD form 294.
 
Well the pen people told me that since I was tdrl when I was discharged in dec04. That I wouldn't be eligible to file a claim for pdbr. But I was removed from tdrl to separation without any benefits with a rating of 10% severance pay in 2008. I am in disbelief here. Something is terribly wrong here.

Ramonica1, I was place on TDRL in May 2000. I remained on TDRL for the full 5 years at 60% before I was discharged with 10% severence pay in 2004. During those 5 years while on TDRL I was 100% with the VA and elected to received all my monies from the VA vice the Army.
The key to my success I believe and I CAN ONLY SPEAK FOR MYSELF ONLY with the PDBR is:

Item 5.
Indicate whether you have received a VA rating for the unfitting condition(s) and whether you have been rated for another condition(s). You must include the VA determination letter or explain why you do not have it available. The PDBR will consider the rating awarded by the VA for your unfitting condition(s) and compare it in reviewing your Service disability rating with particular attention to a VA rating with an effective date within 12 months of your separation. (See DoDI 6040.44 Enclosure 3, paragraph 5(a)(4) for more details.) Delay submitting this application if you want the PDBR to consider a pending VA rating; it will not reconsider a case


My VA rating of 100% was 12 months after I was orginally put on TDRL back in 2000.

Just last month someone from npc by the name of Mrs Butler just emailed me a copy of a separation letter I never rreceived a physical copy via mail nor did I recieved the severance and now having difficulty reaching her I have the email letter
 
I mailed my request for review almost a year ago and I haven't heard back. What should i do now?
 
This subject is not within my area of expertise, but I have a couple of comments.
It might not matter, but you have replied to a thread where the post preceding yours is ~four years old. I suspect a new thread with a complete description might bring better results. Just my opinion, I am not in charge of anything...

It is DoD policy that:

a. The PDBR will reassess the accuracy and fairness of the combined disability ratings
assigned former Service members who:

(1) Were separated, with a combined disability rating of 20 percent or less during the
period beginning on September 11, 2001, and ending on December 31, 2009, due to unfitness for continued military service, resulting from a physical disability as described in chapter 61 of Reference (c);

and

(2) Were not found to be eligible for retirement, including former Reserve Component
Service members with 20 satisfactory years. [quotation end]
