  • Hey Jason, I am one of the guys that was on the NBC broadcast from CA Army NG Just received word last week that my LOD Not in Line of Duty. I can be reached at 916-897-0220, or by email at [email protected].
    I may be out of the loop for a few days. Am in the path of Hurricane Matthew. May have power outages or have to evacuate.
    I received my opinions from the AFBMC but not sure how to respond. I'm getting letters from my VA MST/PTSD psychiatrist along with other doctors. Do I need a counter legal opinion? Are there any organizations that help with board responses?

    Hard to know what response is appropriate without knowing the contents of the advisory opinions.
    As far as organizations that help pro bono, you could try nvlsp.org.
    So I have 11 years 10 months in RA completed meb/peb and was found unfit 20%disability total and 100%from va leave was starting 15th and October 30th last day in army well I got a dui last week off post command found out this week and today was counseled by CO that she would seek ucmj and chapter type unknown not much details i need help

    Jason, I've got a quick question if you don't mind. I was rated 20% DoD for a knee injury I suffered (non combat). However, my overall rating for both the DoD and the VA are 70% even after you remove the 20% disqualifying injury. I received a large severance due to my rank and longevity. Do I qualify for tax exempt and who do I contact? DFAS? Thanks, Tom

    Jason, as I finish my 26 year career I am finding that the "system" is as truly broken as you and Michael Parker have stated. I sent you an email with some broad strokes of my dilemma, and would appreciate and advice/guidance you might have.

    Hello Jason, I started the PDBR 4/14 and I was told that a decision was made and a pkg was sent to me 01/16. I was told "your disability rating was increased from a 0% rating, but no money will be paid to you!". During the PDBR my VA rating was only 70%. I just received a 20% increase in April, but the PDBR was already complete. Can you give me some clarity?

    Would need to see findings/any correspondence to know what is going on. But, an educated guess, the PDBR likely changed your disability rating from 0% to 10% or 20% (result= no change as to retirement status, which would require a 30% or higher rating).

    Not sure the relevance of the 20% VA increase from April. In any event, after the PDBR, likely avenue for any further appeals is through the US Court of Federal Claims.

    Hi Jason. I wonder if we could talk. My husband was originally awarded 30% Service Connected Disability under section 1151. We appealed because we felt the rating should have been higher and after 2 years, they came back with a proposal to sever his service connection. Our local hearing is July 19th. Thanks so much!
