Received ratings today question to move forward with formal board

    My husband got his ratings today for Schizoaffective disorder. 80% va and 50% DOD. We are thinking of moving forward with the formal board. We would take the DOD percentage bc it would always be monetarily higher than VA. He has 14 active but 19 total years of service.
    He has symptoms that would qualify him for 70% under the mental health diagnosis language.

    1. Should we fight this for a formal board? What documentation should we start gathering?
    2. Is there any chance they could lower his DOD rating to less than 50%

    At this point, the formal board cannot raise or lower your percentages. That is VA issue through a ratings reconsideration.

    The formal board would be for changing the conditions as fit or unfit.

    Again, if he has symptoms that meet the 70% requirement, you should appeal to the VA not the formal board.

    As far as paperwork gathering, you should get him examined and have the verbiage of the 70% criteria included into the doctors exam. The VA needs to see additional evidence.

    Fight it until he gets 20 years. More compensation if he has 20 years. Also, he is getting a check while going through the process. Look at all conditions and try to show they are more serious than what have been rated to be.

    If you feel the condition should be rated at 70% and you have medical evidence, request a VARR. The rating will be raised if it meets the standard, stay the same if it does not.

    VARR will take 30-90 days to complete.

    You will still get the VA C&P $$ no matter what, since it is tax free. If DoD medical retirement is higher, then you will get that difference paid to you.

    If your husband has any combat related conditions, he can apply for CRSC to restore some or all of the VA offset.

    Thank you for advice. We got counsel from OAC and took the 50% DOD. He retired Friday and last day active duty is April 18.

    What did the VA rate the schizoaffective?

    Hmm, it's actually TDRL. The Temporary Disability Retirement List (TDRL) is a list of Service Members found to be unfit for performance of military duty by reason of physical disability which may be permanent, but which has not sufficiently stabilized to permit an accurate assessment of a permanent degree of disability. Take care!

    Thus, I quite often comment that "possessing well-informed knowledge is truly a powerful equalizer!"
