If Severance Pay Is Combat Related & Then Retired Must Pay Back?

I have a question- the VA is not supposed to garnish/recoup Combat Related Severance Pay. If then retired, years later, after receiving combat related severance pay, must DFAS recoup it even thought it is combat related?

Also does anybody know an independent accounting firm that can calculate VA pay recouped and what DFAS actually owes in back pay?
 
Yes. VA doesn't garnish because the law specifically allows them to pay the compensation in that scenario. The BCMR correcting your record removed the severance pay as something allowed to be paid, regardless of cause, so it must be recouped by DFAS. You can submit a request for forgiveness of the debt, since it wasn't your fault the debt was created.

No idea on an independent accounting firm. History VA pay charts are available and you should have a beginning and end date, so calculating how much VA pay was recouped should be doable. Military pay charts are also available, and you should have a begin date for that. Any accountant, or anyone with a spreadsheet, should be able to figure it out.
 
ScoutCC- thanks for reply- how often does a forgiveness of debt letter actually get approved as I am not up for another major fight?

Also who do you submit such a letter to and do you know of any example letters that have actually been approved anywhere on internet and if so could you possible provide links?
