UNFIT FOR PAIN IN KNEE PEB

I'm suffering from new conditions such as my back (has got worse) and panic attacks(has got worse). The PEB did not link any of these symptoms with my knee pain and they only want to give me 10% for my knee. I didn't join the military with this condition and as of right now its not going to get any better. What are the chances that the board would consider the other two conditions in order to receive at least 30% retirement?

Based upon what's written, it would seem that you have been recently provided your IPEB findings at this particular point in time; is that correct? If yes, then you should seek the immediate assistance of an IDES attorney for recommendations about your individual situation prior to the required time to formally submit your reply.

In retrospect, do you have medical evidence and/or medical documentation supporting that your back medical condition and panic attacks medical condition affect your ability to perform your assigned military duties? If yes, then you may want to consider requesting a Formal PEB (FPEB) hearing to have the aforementioned medical conditions considered "unfit for duty" at this point. Take care!

Thanks for the reply. I do have an appointed attorney but he's not really much help. He stated that I do have a case but he does feel that they would change their mind about my case. I would like for them to consider my back and panic attacks as a cause from my knee pain and instability.

I agree you need counsel.

The odds of PTSD being found unfit depend largely on the percentage the VA finds for PTSD. Look at the language the VA uses. If you are 50% or more then you can make a good case that PTSD ought to be unfitting. At 30% are less it would be difficult, in my opinion.

Yes I have the a few documents as well as new possible evidence that may be considered unfit. But to be honest I don't think that they are going to even consider my other issues as unfitting. I have a feeling that they are going to most likely denies those other items as an unfitting conditions, just because they have that power to do so. Hopefully my Doctors with have everything written up correctly. But my conditions are worst than before.
