§4.129 Mental disorders due to traumatic stress.
When a mental disorder that develops in service as a result of a highly stressful event is severe enough to bring about the veteran's release from active military service, the rating agency shall assign an evaluation of not less than 50 percent and schedule an examination within the six month period following the veteran's discharge to determine whether a change in evaluation is warranted.

I was rated 100% P&T for PTSD and this was combined with my other conditions that added up to around 90%

Question: Will I be reevaluated on old or new stuff since I got out of the military? My new or old treatment records? Also, any input from those that have gone through a reevaluation for PTSD would be helpful.

Why are you having a re-eval if you are P&T (Permanent & Total)?

I understand that part of the eCFR. I was questioning your claim of being 100% P&T. If you are 100% P&T that means your condition is stable and not expected to get better. So, while the eCFR does have a 6 month re-eval requirement for mental conditions caused by traumatic events with a minimum rating of 50% assigned, if the vet is considered stable and is rated higher then the min 50% then they may not require a re-eval. The whole purpose behind that rule is to provide a min rating for vets that may not be stable and could likely recover once leaving the military environment.
 
P&T does not directly correlate to PDRL (Permanent Retirement) I know it sounds backwards, but the TDRL designation that you more than likely received is what is requiring you to be RE-EVALED.
I was retired PDRL. I was not retired TDRL. My other conditions besides PTSD were rated a combined 93%. My PTSD was also rated 100%. I was IDES so both DoD and VA were the same rating.

1. I got PDRL because of the following statement on my DA 199: "Permanent retirement is recommended based on severity of the Soldier's conditon and the improbability that this disability rating will change. IAW the 14 October 2008 Policy Memborandum on Implementing NDA 2008, Paragraph E7.2.1, the Soldier's rating is 80% or greater and stable without considerating of mental disorder."

2. The Rating IAW VASRD para 4.25 and 4.26: Bilateral Factor: 30% combinded with 30% = 51% combined with 30% = 66% combined with 10% = 69% plus 6.9% bilateral factor = 75.9% wich rounds to 76%.
100% combined with 76% (above) = 100% combined with 40% = 100%

3. What does your original VA award letter state for re-eval on your MH condition? Final-per 4.129 SM needs a mental exam 6 months following the discharge from AD.

7. I went to the Veterans Service Officer and he read everything and said I was 100% Total and Permenant. I went to the VA Clinic and they have me as 100% but not Total and Permenant.

Your situation is a new one for me. My initial VA letter did not have the re-eval on it for MH. But I was not VA rated at 100% for it like your received rating.

My VA letter clearly said 100% P&T, so I didn't have to take it to a VSO for deconstruction.

At the time of my initial VA rating/award, I was also receiving SSDI. I had submitted my SSDI award letter to the VA at the start of the IDES process, so they knew this part about me from the very beginning.

I wonder if this has anything to do with why your situation is different than mine.

Are you in receipt of SSDI? Does the VA know about this?

Yes. I understand each agency has it's own "stand alone" standards. But when I mentioned to the VA guy who did my initial VA IDES claim that I was in receipt of SSDI, he asked for a copy of my SSDI award letter and sent it forward with my packet.

I hope someone else chimes in on your situation with a satisfactory answer as I am at a loss to explain the "whys" behind yours.

Indeed, during the submission of my VARR request, I included a request for a "total disability" compensation of benefits review and included all applicable SSA SSDI documentation as supportive medical evidence.

As such, hopefully during my forthcoming evaluation for DoVA final ratings, the DoVA D-RAS shall determine an increased P&T rating along with my DoVA 100% proposed rating already granted.

Thus, I quite often comment that "possessing well-informed knowledge is truly a powerful equalizer."

Seems pretty clear that you are 100% P&T.
 
I just want to say I am 100% PERMANT AND TOTAL AND RECEIVE SSDI. IT TOOK ALOT OF TRICKS TO FIGURE OUT HOW TO GET THERE. I AM A COMBINED 100% P&T. I DO HAVE 100% IN PTSD AS WELL AS OTHER PERCENTAGES IN OTHER DISABIBILITIES. JUST FOR PTSD ALONE. I WENT FROM 30%, TO 70%, TO 100%. When I finally got a combined VA rating of 100%. I was still not at P&T. instead of waiting for the next future evaluation, I used DAV Disabled AMerican Veterans to help me get the P&T. DAV gave me a one page piece of paper that woould ask a few questions that only the PYCH doctor could fill out.
The paper title is called PHYsician Medical Opinion. One of those questions was the most important one tat asked: 5. "In your opinion, is there any possibility(50% or more chance) that the veterans condition will improve throughout the veterans lifetime based on his current level of disability?_____ YES ______ NO
6. IF NO, please give a rational below? ""

So if the Pshych doctor answers NO then you submit it in and you are guaranteed to get P&T. But if the PSCYH doctor answers yes then to not submit a claim for P&T. Convince your favorite PYCH doctor why he or she should answer NO. One of the best reasons to convince your PSYCH on why he should check NO that is because he needs to hear you say in your own words that No mater what medicin and and treatmeant there is i feel that I will never get better.
THe VA hospital game is too check off every thing saying you meet the 100% but they never check the Permanent that is where you seek a private Psych who after reviews all the rating evaluations by VA will check NO on that piece of paper depending how you play your cards with your favorite PSCYH doctor. But I would never present this paper too the VA PSCYH doctors only private PSYCH doctors.

Hey Bud I went through IDES and have the same thing on my 199 stating permanent and improbability to change rate, but my final letter doesn't say permanent and total. I was medically retired from the army in 2013 va 100%service connected but for some reason it took 9 months after I was out to get it final award letter I used the Ameirican Legion to help me but I was unaware about the P and T until I recently got married, I wonder if that was a mistake on my final award since I had same kind of documentation. I am also on SSDI, I do have to get reevaluated on PTSD as well for the behavorial, kind of same thing you got. Whats yer thought people about this??

Sounds like you are, but you should be able to see P&T on eBenefits. Your benefits summary letter should state that you are P&T and under additional benefits it should state: Entitled to Basic Eligibility under the Survivors' and Dependents' Education Assistance Program.
 
My VA PSYCH did an Assessment of Mental Capacity Evaluation for my SSDI. It actually sealed the deal and gave the Judge good documentation to overrule the State PSYCH since she is my primary MH doctor.
I have 70% for PTSD/Anxiety and a combined 100% P&T rating and finally entering the IDES. From what I have been told by several people on the site it is difficult for the VA to reduce your rating as long as your still getting treatment.
This post has a reference to reexaminations and continuation of a Total Rating.
