PEB Playing Tricks

Recently got back from a formal board in JBLM. Sent me back to QTC for another exam. PEB now holds the exam. Got a call yesterday from attorney saying they are going to sit me down with a new 199 with additional failing conditions NOT yet rated by the VA. They are telling it doesn't matter if VA hasn't seen these added failing conditions because they said I can opt for a VARR for new unfit conditions. Does this make sense to anyone? Is this legal? Attorney said its not the normal way for PEB to do things but it makes sense for them so they can expedite my case.

Is there anything I can do about this? Is this something to really worry about? It is odd that they want me to opt for a VARR when things haven't been rated yet.

What would you do if anything? Needing help.
 
mmmmmm.......Well I kinda understand it but I'm sure they are trying to speed up the process somehow for you. I had a VARR initiated from the JBLM PEB in Aug 2014 and I am still waiting for the VA to rate one condition! Maybe they are trying to save you time on the back end when your ratings come back from the abyss of the VA!!!!!!!!!!!!! good luck
 
That was a thought of mine too. You have been waiting a very long time for just one condition. Your PEBLO hasn't tried to call the VA?

So after your JBLM did the PEB present a 199 to you that had conditions on there that hadn't been rated? Then they had you file the VARR? Is that correct?

Actually this is very similar to what I am hoping will be done with my pending Formal PEB. That the F-PEB adds additional Unfitting conditions (and their associated ratings) that were overlooked or ignored so far in the process.

I'm guessing by the way you put it that you don't want to be medically discharged, is that the case? If not, adding ratable conditions in an expedited fashion seems like it would be a good thing.

Either way I hope it works out for you in the way you want it to, and please keep us posted on the outcome.

Could you please expand on that, if the FPEB is willing to ADD conditions and rate them accordingly, and do this without waiting for a the VA to get around to it, how is that going to short change you?

Will it limit or hamper your argument to the VA to have those conditions added and rated by them at a later date? And if so, how?

It seems to me if the FPEB ADDS and rates you on any condition(s) that were not addressed by the VA during the C&P exams, it would only strengthen your case for VA compensation for those conditions when you go to the VA post-discharge.

I agree and see that now. I just was questioning things because the attorney called me and wants me to sign a 199 next week that the VA hasn't seen and rated. I understand that it is rare for the PEB to ever do this. However after reading your comments and talking to more people and legal, I can see now that it is benefiting me in time. thank you for your comments. I was just thrown off by this recent news. I clearly have understanding now

Sounds alright to me as long as the VA rates this condition prior to finalizing your PEB and you appeal options remain.

I have a question I new this but. I my med board 12/11/2014.. i finished my last VA appt about 2 week and today I go lolling to ebenefits website and now my status says pending decision approval . Your claim is currently located in our Rating phase. I haven't been assigned a PEBLO.
