Proposed Ratings

Today, I was faxed my proposed VA ratings. The VA proposed a collective percentage of a 100%, but when I calculated my individual percentages, they totaled roughly 92%. Is this possible or an error with the VA?

Also, I feel like I want to dispute a rating (bilateral flat feet) that should of gotten a rating higher than 0%. Should I appeal that rating or agree to the proposed ratings? I feel as if the VA may change my rating once I receive my DD 214 and get actual ratings, IF that's possible.
 
To get 100% you are supposed to be 94.5% or more. You may have been wrong on your calculations, or the VA may have made a mistake.

If you aren't against doing it, list your conditions and your ratings for a second look at your math.

I used 2 calculators and both equalled 92%. The only thing I can think of is that the VA is planning to give me IU, which would cause me to get 100%, which I wouldn't want. I can still work as long as it's not alot of labor.

I also calculated 93% for a 90 overall, so I don't know if there is something else that would make that 2% difference that isn't on that sheet. But as far as I am tracking in the IDES process you can only really appeal the "unfitting" injury/disability and not the normal VA claims. But once you are out then you can do paperwork to have the VA relook ratings and get them higher if able to.
 
look up something called the bilateral factor. It's something where if you have two conditions affecting bilaterally that the ratings are added and then combined. Not too sure on it myself but that could make up the 2% -3%

You are right. Quite a few disabilities are bilateral and after calculating everything, I seem to sit at 94%. There is probably another factor I'm missing.
 
You claimed it as bilateral. That's why it's in parentheses. That means that when you and your MSC filled out your claim, you were claiming the issues in both feet. I claimed a bunch of bilateral issues because I had pain on both sides. I only got diagnosed with one issue that had a bilateral factor. Since your Pes Planus wasn't bad enough to a better than 0% rating, you don't get the bilateral factor (additional 10%). On the explanation of the rating, it tells you what is required for the next highest ratings.

My proposed ratings didn't add up to make it to 100% but there was a statement in it that said something about how the used a chart and not a mathematical computation, that considers the combinations of conditions and that was how they rated me at 100%.

Read everything and you will most likely find the reasons for everything. It was a pain in the butt since my proposed ratings were over 20 pages, but I read it through three times and each time I picked up something new that I had missed before.

However, one thing I like to share with everyone is:

§4.129 Mental disorders due to traumatic stress.

When a mental disorder that develops in service as a result of a highly stressful event is severe enough to bring about the veteran’s release from active military service, the rating agency shall assign an evaluation of not less than 50 percent and schedule an examination within the six month period following the veteran’s discharge to determine whether a change in evaluation is warranted. (Authority: 38 U.S.C. 1155)

The Army only counted DDD as being unfit for service. Even with diagnosis of PTSD, I was still found fit.

Would you happen to know what chart that is? My packet didn't include a chart or details. Only my percentages and basic veteran benefit info.

I have no idea. I was just roughly paraphrasing what my proposed ratings said.
