but even thou isn't combat related you still have other requirements that make you exempt to pay it back. which is my case, I'm not combat related but I don't have to pay it back.....your MSC would of tell you that.. doesn't make any sense right? but hey My MSC didn't tell me anything about paying it back and I ask him like 3 times and he said to listen to his words "YOU DONT HAVE TO PAY IT BACK"
What is your case then if you dont mind me asking?

I talk to my MSC and told me because of the add up of my Conditions are at 100%, I will not have to pay it back. taxes will have to but I have to send the latter to DFAS So they can refunded before they reported to IRS. I can see that we both have same rating, did you got severance pay? if you don't mind me to ask....

but still don't understand the reasons very well but stated that I WILL NOT HAVE TO PAY IT Back!!! and I didn't did the math for how much monthly will be recoup and all that
 
I talked to the va debt department yesterday and they informed me that after 2008 they started allowing individuals the option to take a severance pay and still receive va disability as long as your condition was caused while in combat or supporting a combat mission . Hopefully this helps answer some of your questions.

Are you 100% or 100% P&T? I am just trying to figure out the difference between our cases that would mean that you do not have to pay it back and we would. I am getting severance pay as well and my MSC and PEBLO both talked to me about how I would pay back the severance pay.

I was just talking to a vet that was medically discharged and he said the same thing. No longer matters for me b/c as of yesterday I got my ratings, and the AF decided to medically retire me. Totally did not see that coming!

I am 100% P&T from the VA and don't get me wrong I know of what I read on CFR and saids that a portion of my benefit will be toward to pay severance pay. But MSC told me that I will not have to pay it back at all. just taxes will be deducted.... I gonna eMAIL HIM AGAIN ASKING THE SAME QUESTION TO SEE WHAT HE SAIDS NOW..

You might already know this, but just in case, if they deduct the taxes you have 1 month to call DFAS to have them refund your taxes. They will request a copy of your VA letter to show that the condition you received Sep Pay for is also a VA recognized condition (or something like that). If you wait to request the refund you'll have to work with the IRS to get your tax refund.

So what was your rating from the DoD? What do you mean without adding your condition?

What I mean is that I have your same rating 20% DOD and 100% VA in my case and basing of what my MSC said is that he did his MATH and by just adding few of my condition ratings, I still be able to be awarded 100% and therefore I don't have to pay my severance pay because Im not getting compensated for the same condition twice, In order words VA still recognize me as 100% P&T For the conditions I have without including the ratings for what I was MEB Which is 20% DOD & VA....

Oh ok. So then your severance pay will be taxed and you wont get that money back? Mine told me that I will have to pay 20% of the $3400 a month I will get until my severance is paid off. That makes sense.

and yes that is right because if I have to include the 20% from my peb I would of have to do the same , you know in my case I have 29 conditions with 24 of them with rating... and yes taxes will be deducted but I can send that letter to DFAS so they can refund it back......

So then you got an ideal situation where you were rated at 0% for all of your unfitting conditions but still considered unfit, congrats.

The finance people told me to expect it a few days after I am separated.

so by Monday or Tuesday Hopefully !!!!! Good For you !
my last date is DEC 30 and few day after we all will be in holydays so I'm confuse when I should get mine....
