Air Force Reservist and Diagnosed with Multiple Sclerosis

I am a reservist (IMA) and was recently diagnosed with Multiple Sclerosis (MS) a few months ago. I saw my PEBLO for the first time a couple days ago who went over the entire process if I am to be MEB'd. Package will be sent to AFRC for recommendation. What bothers me the most, is that I was not on orders when diagnosed (was in civilian status). I was active duty for 8 1/2 years and been in the Reserves for 4 years, no break in service. Determining whether or not it was "in the line of duty" is my issue. An administrative discharge is what I don't want to happen. I am a Security Forces member and my MS treatments involve injections three times a week.

Will this result in a Medical Retirement, Military Discharge w/ pay or will I be found "fit for duty?

Trying to put my mind at ease and looking for advise.

Thanks in advance!

I am a Reservist (TR) and diagnosed with MS after I got an MRI in Dec 2016. My package is at AFRC (I think?) and waiting to hear more info. I was on an order to go see the Flight Surgeon when I had the issues which were diagnosed with MS. I have been asking that this case be called an "LOD" due to being on orders when I was diagnosed. Just this morning I found out my AF flight doc declined the LOD due to the fact that he says MS is a disease that doesn't warrant an LOD? I am a enlisted flyer and have been Perm Disqualified from flying form AFRC SG/CC at this point. I have been on orders for the last 22 months and have enough AD points to retire, so not sure what I am going to do either?

The 8 year rule will apply for you. While MS .ay not be considered in the line of duty for DoD disability it will be service connected for VA disability. Your MEB should automatically put you into IDES to get your VA rating started. I recommend reading up on US code Title 10, 1207a. As well as 36-2910 and the 8 year rule.

Fishmom- I also looked at the 8 year rule, but from what i read, it is considered in a 'deployment' type of status? Am i wrong in thinking that?
OT - I am actually closing in on the 1095 rule; have you heard of that? It is only a Personnel type of action (not PEB), but it is basically that I have worked 1095days or 3 full years, in a 4 year 1460 days period. It might make me come off orders, which would be bad......

LeRoy60 - Only in my opinion on here, I do know that there are folks still in the military that have MS. I am a flyer, and know that my MS will probably take me out of flying. No waivers for flying have ever been approved in AF/AFRC. My current symptoms are not too bad having only slight numbness in fingertips. Sometimes my MS it's worse than better, but normally I feel okay. My guess is that they will maybe find me Fit for Duty, but make me Retrain to another job. I don't want to do this, so I am just waiting for any more news on my case?
I was looking at the PDRL vs. TDRL scenario, and thinking about MS and how it's classified as Unfitting due to the unknown nature of the disease? As I have been told, MS is a progressive disease and no cure for it, just medication to try to keep it 'under control' best as possible. Does anyone think MS could fall under the TDRL criteria due to it's nature? Not hunting for that outcome, just wondering about the future?

I am familiar with 1095 rule. The 8 year rule will apply when referred to MEB not just during LOD investigation. The bottom line is that if you get sent to MEB, you can ask CC to refer you to DAWG which is the first step, your TAFMS on your CDB will for with the package. If your TAFMS is greater than 08 year 00 mo th 00 days (080000) the 8 year rule applies to you and you should be enrolled in IDES to start the VA rating process. I know gsfowler is much more knowledgeable on this. I a just giving you the information that I have figured out to this point. No one in AFRC or my unit is very forthcoming with information about this process. I so discovered very high ranking people in my chain had never heard of the 8 year rule. My appeal has gotten them finally thinking and asking questions. AFRC seems to be operating on the "this is how it's always been" principle even if it is fundamentally wrong.

Most things with reference to my case are moving 'fundamentally wrong'. I asked my Med unit twice, and my CC even emailed the Flt Doc about calling this an LOD since I was on orders but that was denied due to the Doc stating that I have had MS since birth? WTH is that all about? So I have passed every physical and Class III flight physicals since 1987 but I've had MS? Ridiculous

Just wondering what basis you stated that "While MS may not be considered in the line of duty for DoD disability it will be service connected?"
