Combat Injured Vet Tax Fairness Act 2016

Nothing on my side. Been a month and a half and still have not received the check.

I called the IRS on Wednesday and they told me my form was not correctly filled out and it was rejected. It was rejected in October but was not notified.

I copied this from another post.
I spoke to an actual person.

Hope it helps!

Are you requesting the default amount based on the year of discharge or the exact amount based on tax returns?

If the latter, how did you determine the information needed, assuming you don't still have the returns?

Default amount.

huh, wonder what wasn' filled out correctly. the website makes it seem pretty straight forward for the default amount.

Anyone heard back about getting the information needed to file for the exact amount?

All I was sent was a letter to sign stating I would accept the defaulted amount. Sent it back. Around mid October I got a letter stating I should receive my check in a couple of weeks. Still no check yet.

Wah?!? You don't have to take the default amount, which is actually why I started this thread in order to track down a method of getting the correct information to file for the exact amount.

I'm in the same boat...well, almost...I'm in Texas. ETSed in 2002, so there is no way that I can get an IRS Transcript from back then. Plus, I shouldn't be expected to keep a copy of my Federal Tax Return for 16 years!

I reached out to DFAS to request a copy of both my W-2 from 2002 (since all of my employment in that year was DoD-related...Active Duty, NAF, AAFES) as well as the Disability Severance Payment voucher, which was issued about 30 days after my last LES. Go to https://corpweb1.dfas.mil/askDFAS and select Military LES Requests.
I was able to get my transcript from 2002. I had to speak to a person, it wasn’t possible with the automated system.

Yeah, I literally just finished paying my recoupment in June of this year (16 years and 5 months post medical separation)! It was a pretty nice severance at the time, just wish I knew then what I know now and I wouldn't be going back through the process all over again with a PDBR.
Got my letter 2 days ago. I’m getting it all back (plus interest). As long as I don’t dispute the amount (uh, NOPE!) I will get my check in 2-3 weeks. I’m like a kid waiting for Santa the way I’ve been checking the mailbox every day for the last few months!

No, you can get the exact refund, based on your return from that year. Also interest. If you get the standard amount and then later figure out what it should have been, you can have it adjusted, deducting what you already received.

Still a bit confused on this. I went to the 1040X instructions and found some information about what evidence is needed but does anyone know of any of the Veteran's organizations that will help with filing out the 1040x I have no idea what to put where. For example: if we don't need our tax return from that year how do I fill out the adjusted gross income and as such.

Hello fellow vets and families, I followed the previous instructions in this thread on how to speak to a live person and there is one more additional detail. They will ask you to key in your SS # and confirm it is correct. But DO NOT press anything after that; it will redirect you to a live person that was very kind and helpful.
They received my 1040x and confirmed that they received it on 11/5/2018 BUT it has not been uploaded nor worked on yet. I am hopeful my tax guy prepared it properly and the rep said it could take up to 16 weeks to be processed and paid out. I would imagine we all should wait every bit of that. I am just glad they got it! Have a great holiday everyone.

JEEBUS!!!! 16k in taxes daaaaannnnnngggggg

Looking forward to any info you can provide after they receive/update your paperwork.

I sent a message to the IRS accounts on twitter, see if they say anything
Got my check on Thursday!! I’ll post a timeline in a bit. WELL worth the wait! The 16 years of interest was more than the original amount withheld. I called Thursday morning and the nice gentleman I spoke to told me it had been worked and gave me the total ( we BOTH squealed), then he told me the check hadn’t been cut yet, but it should be soon. I resolved to not stalk the mailbox for at least a week. Even sent my son to get the mail. Low and behold the check was there! When I deposited it the next day the teller did a double take and looked and me before she checked the IRS fraud site and got an override for my deposit!! Good luck!!

You can get your adjusted gross income off your transcript. You’ll have to order that, and depending on how long it’s been you may have to do it manually, rather than online. The IRS site has instructions for filling out the 1040x, all the information will be on the tax transcript. It was a little more complicated than doing my yearly taxes with an online site, but definitely doable, and worth it if it’s been any time since your discharge and you had a substantial tax withheld (that info is on your DD214 in the comments section).

If you select the standard amount, do you think they still add on interest?

Yes, I saw someone else had received interest on their standard refund on another thread (sorry, I can't recall which one) and that's how I knew that I might actually get some back. I really thought it would only go back 3 or 7 years, but they paid interest all the way back to 2002.

Well this is good news! I wonder how much interest over 10 years on $2400.

I called and said they could only do transcripts from 10 years back so I was 2 years too late.... Was there something specific you said to them when you called in? I went ahead with some of the advice above and got the LES from when the Disability Severance was distributed and how much tax was withheld but at a loss on the Adjusted Gross based on what the IRS rep told me on the phone. Should I just keep calling back for the transcript until I get someone that says ok here it is we will mail it out to you? Thanks for the words of confidence at least gives me a little bit hope in getting what I should be getting. I really don't want to take the default amount...
