When do you get to choose whether to have DoD pay or VA compensation

When you file your VA claim, you must agree to waive (lose) retired pay dollar for dollar in the amount of VA compensation received.

Some retirees have reported they do not have a copy of the VA claim form as it was completed during the IDES electronically.

BTW, it is not a choice of one or the other. It is a choice to receive VA comp under the cirumstances I described. Occasionally there is retired pay left over that the retiree gets to keep.

I'm still in the IDES process, I didn't realize I already elected to waive my military pay. Is there a way to change that? I want DoD pay and not VA comp.

If I can't do it during IDES, when can I do it and how?

I don't know if you have filed a VA claim...it normally is part of the IDES process.

You will be one of the few people I have encountered who does not want their VA compensation.

You do understand that the retired pay is only waived to the extent of the VA compensation amount...yes?

Example:
Retired pay =3000
VA comp = 2500
3000 minus 2500 = 500 residual retired pay
Your would receive:
VA comp = 2500
Residual retired pay = 500
TOTAL: 3000

Another example:
Retired pay =2500
VA comp = 3000
2500 minus 3000 = zero residual retired pay
Your would receive:
VA comp = 3000
Residual retired pay = zero
TOTAL: 3000

Finally, another:
Retired pay =2500
VA comp = 3000 Declined/not elected
Your would receive:
VA comp = zero
Retired pay = 2500
TOTAL: 2500

One of the methods to change/decline VA is to submit a letter stating so to the VA. Your PEBLO or VSO can help you with this.

One is NOT eligible for CRSC unless they receive VA comp and their retired pay is reduced by that amount.

Does SMC affect Retired pay or it is a bonus to it?
Yes, as a person who received both S and K, I can offer that a SMC amount affects the waiver/reduction.

Btw, SMC-S replaces the 100% VA compensation rate with a higher amount. On the other hand, SMC-K is added to whatever a veterans is receiving from the VA.
