Title 32 Technician Medical Retirement Scenarios (Please limit posts to "Technician Medical Retirements")

I’m assuming cases where public law has to be used will take twice that long. I’m guessing the first go around (when it will be denied) will take the time mentioned in the article. Then it has to go through the process again and trigger public law. (I’m new to the process, so this is just speculation…)
That's what I was thinking also. Our situations are a little bit different than other federal employees. I was denied quite a while back and I keep thinking getting close who knows. I found a group on Facebook that follows OPM civil service disability retirement. I noticed the timeline seem to vary but are taking quite a while. But I think our timelines will take even longer same reason because we have to be denied and then get accepted later.
 
Update-I signed the military retirement papers earlier this week. HR in Springfield (civilian side) said in IL you have the option to go LWOP or stay on in your civilian job until OPM makes the decision on the disability retirement. She said it takes about a year right now for those decisions to be made. Hopefully the rest of you will receive good news soon.

As others have experienced, the lady in HR can’t do anything until she has the retirement orders. I’ll be staying on until the decision is made. I’ll update again when I have more progress.
That's really good news for you, they didn't get me the option to stay I had 30 days from some point I don't remember exactly when. But I did have the option to stay in LWOP. I was in LWOP all of January and part of February. If I would have stayed in LWOP I could have kept my health insurance. I hope it doesn't take a year for me to get a desision.
 
I was a WG10 step 5. Yes I will really enjoy the back pay. I should get back paid to the beginning of January. I wonder if we get Backpage when interim payments start or if we have to wait for it to be completely completed?

I went through medical disability retirement from both my WG11 Step 05 and E-7 positions back i. 2015. I had a good HR and it was still confusing. I am also 100% with the VA and that was a 5 yr struggle so if anyone needs help with navigating that mess I might be of help. Also Hadit dot com is a good resource.

Thanks for the information. I just got 100% pt from the VA thank you Jesus!!. Honestly I heard many bad things about the VA and overall I had good experiences mostly with going though the process. Had a couple of raters that I felt didn't rate correctly but tried again and it worked out for me.The VA process takes along time but for me the Fers disability retirement is the worst thing I've seen the government try to do. Actually getting the national guard bureau to take my LOD was the worst lol by the end of this process maybe I will stand corrected. I signed my paperwork middle of November and haven't even made it to interim pay. Think it's been a couple if months since OPM denied medical retirement and were processing it as public law retirement. When I call they say it's in the office that processes the retirements crazy.
 
I have an update Jmc81, I received a letter in the mail from OPM, I can see my mail from the USPS app. I could see that it is a determination letter. I have someone going to get it and will update again to see the results. Since I’m still here in Oregon.
 
Well, just saw the letter and says it was denied under regular FERS, so It gave info on Public law and just emailed my army benefits representative. 06-03-22
Applied and application sent in 2-22.
So about 4 months to get denied.
19 JAN 22, is when I got med from tech side.
 
So I emailed my abcc rep and he also got the info. Here’s the email with his response. Hope this helps Jmc81.

I received my denial letter 3 months ago. I thought by now I would have interim payment. I haven't talked with anyone from ABC for a long while. I never received any emails from ABC. next week I will do some calling see if I can figure out what's up. One of the guys on this forum months ago told me interim pay starts couple weeks after separation that sure didn't happen. I was just on here last night looking to see if anyone posted anything sometimes it email's me sometimes it gets sent to junk email. That's awesome that you progressed, maybe you will leap frog me!!!

Oh man, so once you got the denial letter did anyone from ABC notify you about anything ? I hope you get your pay and insurance situation fast tracked.

My wife is paying for insurance out of her pay now. I Would like for them to not pull out 400 500 month for insurance that they did not give me access to for who knows how long. It is really a fubar system FERS has created. I was looking at my denial letter and I think I emailed my agancy HR and ABC. It was like more of the same now we are going to get it approved under special provision.i feel very luck to have money put away and my wife makes good money as I'm sure you feel the same way.
 
I called OPM for an update on the DR. I received my denial letter March 3 and my case has not moved since April 27. I was told it's waiting on an employee to work it. I asked about suspending my health insurance because we paid to use my wife's insurance. I don't want to pay thousands in back pay to insurance that I was not able to use, makes really good sense to me. I was told call back beginning of July and maybe they could answer my question or it could have someone working it. So slow we are going back in time lol.
 
Has anyone made progress on the DR? I haven't heard anything, crickets. I think Friday morning I will call and look into what's going on with OPM. If it's still waiting for someone to work it I will ask to speak to supervisor, from there if I get nothing or just wait a few more months I will do a confessional inquiry. Not sure what else to do down the road maybe an attorney.

So, I just called the OPM, and the representative told me was case was given to someone yesterday, so some progress after the denial letter. 27 Jun 22 OPM says case given for review.
 
Good morning, update, so this morning I checked my bank acct, and saw that OPM CIV SVC deposited about 2 months of back pay in my account, I will call and see if it’s interim pay or the amount of my 60/40. I checked mypay and it didn’t show an LES.

That really good for you. I tried to call OPM last couple days couldn't get though. Shouldn't you get back paid to January or maybe they don't back pay tell it's final? You leap frogged me!! Lol

Thank you, I called OPM around 9 am, as the other days it would say it was busy and call back later. I’ll fight to get back paid till January lol. I fought 2 years to get back paid for the tech side rehiring at 10 step 1 when it was suppose to be 10 step 5, I got back almost 27,000 lump sum. But it took 2 years. I had to fight it as my high 3 would of been low when I medically retired, but then I got 12 step 5 and worked out even more to my advantage. Good luck to you and will let you know more updates

Got through to OPM and it's sitting at the same office waiting for someone to work it. The guy told me call back in a month and it should have moved by then. I was like nope been told that now two months in a row. He was like you should be finalized in August, I was like I'm not even getting intriem pay then he was like ooooo huh. I asked to speak to the supervisor but they never have called back big surprise. I called and left message with one of the OPM directors and did a congressional inquiry. Next week I'm busy week after I will go after it again. Like you said big government will let you down sometimes you have to push to get things.

That’s the way to do it Jmc81, good luck to you and hope you start to get paid soon. I received a letter from OPM Macon, Ga. I got someone that’s getting it for me tomorrow and sending me a pic. I’ll follow up and let you know what it is.
