My PEB Timeline

Pam is DAV who does the DAV portion for STAP and RTAP. Make sure you bring your medical record. She might find some other medical problem that you might not have claimed and can tie category 2 problems with category 1 unfitting problem

I have that category 1 and 2 issue on my proposed ratings... What do they mean?
 
Chief Jeffers just called a few minutes ago, he set up a meeting in the morning for us to review the findings. I'll update tomorrow after the meeting. For sure though, I am going to Hickam MFSC to see Pam and see if she agrees with the ratings they give me. I wont sign till she sees my package.

Any good news?
 
DOD 10%, VA 80%. Here is my findings:
Category I: Right hip pain, 5255, 10% with severance pay

VA rating:
Residuals of a right hip fracture, status post arthroscopic surgery (referred as hip pain and also claim as chronic pain syndrome) - 1%
PTSD and adjustment disorder with anxiety and depressed mood - 50%
Intervertebral Disc Syndrome(Claimed as lower back condition) - 20%
Right Rotator Cuff Tendinopathy - 10% (dominant arm)
Scar on the 1st interdigital space on the right dorsal hand -10%(dominant hand)
Residuals of 1st and 2nd fingers fractures of the right hand with arthrosis, status post internal fixation surgery(claimed as pain in joints of fingers of the right hand) - 10% (dominant hand)
tinnitus - 10%
left rotator cuff tenndinopathy - 0%
Left hip strain - 0%
Right knee patellofemoral syndrome - 0%
Sleep Apnea -0%
Traumatic brain injury with Acquired auditory processing disorder - 0%
Migraine Headaches - 0%
Radiculopathy of the right lower extremity - 0%
Radiculopathy of the left lower extremity - 0%
Total of 80%

Im appealing it, my psychiatrist and psychologist are both writing an addendum right now to get PTSD as an unfitting condition. My MEB doc wrote a surrebuttal stating that my back pain was reffered pain from my hip. In the process of having my Pain Management Doc who is a Doctor of Osteopathy and my Physical Medicine Doc who is a Physiatrist. DAV will help me with my hand/shoulder as an unfitting condition being it is my dominant arm on Tuesday with my appeal and we will be doing a videoconference with my PEB JAG in San Diego. My MEB doc royally fucked me over, sad thing is I'm staff at his own clinic.

Boy I was livid Wednesday, Faith is helping me out in this process.

Category I is unfitting condition, Category II is a contributing factor to your unfitting condition
 
Who is Pam? Is that the DAV or STAP ladies? I have STAP class next week... I hope all goes well, Good luck!
PAM is from DAV, she is certified VA specialist so she can review you record and later that day she goes to VA and puts your claims in.
 
I figured that you weren't satisfied with your ratings after not hearing back... But see they are doing the same to me 10% for three major shoulder surgeries with severe nerve damage to groups I-V, but the categorized as not connected to prevent people from retiring. I know what they are doing and I think its pure shit.

What did AOC Jeffers say? I bet you were pissed, hell why wasn't your PTSD an unfitting condition? Is that someing you claimed? It's really sad how the PEB and the VA are working around us now... They will beef up all YOUR claimed items, but low ball the hell out of your referred condition.
 
Chief Jeffers already knew that I would appeal, Faith had told him when she saw the results as I was trying to have all my unifying conditions added to my narsum. The doc only wanted to add the unfitting condition that was on my last LIMDU which was my hip. I wrote a rebuttal o add back by his surrebuttal said back injury was connected to my hip pain. I trusted the man since I was staff that he was doing what was best for me. He told me just claim everything else with VA and that if PEB would find those unfitting even if it wasn't on the narsum. Boy he was he wrong! So that's why I am getting all this addendums written for me. He didn't really look at my C&P exams to see my unfitting conditions and ask those specialist like psych for an addendum.

Have you received your Official results from the PEB via the PEBLO yet? (Im out here in Hi as well) My VA proposed rating was completed on 6 April. I called the PEB in DC to check on the status and they said they haven't received my proposed rating from the VA yet. This was 18 April when I called... I am guessing the ratings are sent via snail mail??? AOC was able to look up my proposed ratings in the VA's system. DOD: 80% VA: 90% Again, this is what they proposed... not sure if the Navy is going to accept them. I am hoping they do not change (get lower) when they reach the PEB.

I wasn't able to reply because once I heard from JAG and DAV stating that MEB doc didn't do his job properly I snapped. After years 9 years of dealing with PTSD, over 2 years of severe chronic shoulder, hand, back and hip pain I reached my boiling point. I wanted to do harm to the man, I didn't want any legal troubles so I went to seek help from my mental health. No one was available to see me so they directed me to Tripler. I was admitted at the Psych Ward overnight. The command is pretty pissed that they turned away a SM with thoughts of harming someone and to top it off I am staff. So there are pissed of people.

No, just like you I am waiting for results from the PEB. My proposed ratings were sent from one of the guys at the call center. They were completed on 03 April... I should have them very soon, probably sometime next week. In your case, I don't think they will change your ratings, but since I only have a 10% DoD and a 80% VA, maybe; to be honest I don't care. I need to leave Hawaii by late May because I have accepted a position in Houston. Furthermore, the money I would have received from a retirement at 30% will be the same as 80% VA anyways, but I will lose TRICARE (this will cost me about $400 a month for family insurance plus all the medical bills/co-payments. To be honest, I don't have anymore evidence to prove my further disability if I go to a formal board/rating re-consideration.

I'm sorry to hear that you had to go through that... It is really unfortunate, sometimes that's the "kinda" care you get at the clinic. Do you have a civilian doctor at the clinic? I have Dr. Velazquez as my PCM and he has been pretty decent, I just wish he would have listed by referred condition as neuralgia/right shoulder/chronic pain and not just right shoulder condition.

My PCM is Dr Manuel a civilian. My MEB doctor was dr Velazquez. He was really incomplete with my Narsum. He told me only thing he can list was what was at my LIMDU paperwork. I'm calling JAG to inquire about MEB packages from late 2011 to now as he is approching his PCS date. He might just be rushing these packages so it can be closed by the time he leaves in June.

I chose surgery over CPAP, I believe eh gave me 0% because my last sleep study was normal was my surgery.
 
Another thing that pissed me off was that TBI was 0%, I couldn't believe it.

Appeal it and start talking to PEB JAG in San Diego, No Navy PEB JAG on this island. If you need their emails and numbers let me know. I think what he did with you is he only looked at the condition you had in your LIMDU papers and not even consider what the C&P said.

I talked with a former LCDR named Suri (I think that was his name). I called him about BCA issues. He is a very good PEB lawyer, I think he is located at Balboa right?

Dr. V. sent me my NARSUM via email and had me look it over and add stuff regarding the injury, but he did all the exam/conditions information... The funny thing is that my LIMDU paperwork from him dated Oct 2011 lists neuralgia and chronic pain; however, my NARSUM only states right shoulder condition and chronic pain. I got low balled on that shoulder crap only 10% and the VA rated my neuralgia for my shoulder at 20% (combined it would equal 30%), but since it was not considered a referred condition (I guess Cat 2), I'm getting a severance rather than a retirement. I think its crap... He is a good doc, I think he is just overwhelmed and is getting really short and I know he's ready to leave, but that is no excuse for your package. Dr. Manuel could not do you MEB, she knows about your conditions? He is my sole provider for medication, so I have to see him. The other docs there are not very good. I saw several others in the red team and they are crap.

I hope you get all this resolved... I think you will, it's just going to take time.
