MEB found fit, 10 days...

Got my MEB results in today and was find of shocked to be found fit. Below is the Findings comments.

"Confirmed diagnosis of PTSD and Panic Disorder with Agoraphobia. Treatment has successfully diminished or resolved the symptoms sufficently so that the member can perform the duties of his MOS at sea, on shore or in a deployed status, the facts of which are supported by the NMA. Of special note, the member can perform the following duties of his MOS. Therefore, the member's diagnoses do not interfere significantly with his ability to carry out the duties of his office, grade, rank or rating."

This blows my mind... I have no diminished or resolved symptoms, no where in any medical record does it state that. The NMA was written by someone of whom I met 1 time before it was written. I am currently not working in my MOS. I am a SSgt working as a company clerk (I am not admin).

Where do I go from here, I did not sign anything and have 10 days to submit a rebuttal. Is there a speical format? What should it contain? Any help would a appriecated as I am somewhat lost here. Thank you.
 
Appeal! Go see your MEB JAG team immediately! If you have a P-3 on Psych, you are unfit persay. Gather letters from your fellow NCOs, Officers and Soldiers that work with you or have worked with you and know the issues you have. Go through your medical records and gather your proof. Do all of the leg work yourself and get help from everyone you possibly can! Your MEB lawyers will help with memo's, recommendation letters, everything!
 
Your Ombudsman and MSC will be good resources too!
 
I shot an email to the DES attorney and will see him Monday. I think getting my medical records is a good idea in proiving no diminished symptoms. Does the 'evidence' have to be new though, as in paperwork and records not submitted?
 
New and old, use everything available to you. Especially new evidence if you are currently going through counseling and/or on meds. Letters from your counselors/psychiatrist/psychologists are highly recommended being they see you repeatedly and know you best.
 
Will do, I was placed on a new med today and see my primary pyshcologist on Wednesday.
 
Talked to my doctor, is their a format the letter needs to be in?
 
Also, what is a P-3?

P3 is a Permanent Profile 3, non-deployable - it's army lingo, but close enough for understanding I hope.

I don't really think there is a set format, but legal would answer better than I. I would suggest memorandum format so it looks more professional.
 
Matt- keep in mind that if you appeal and the PTSD in found to be unfitting, you will likelyget a 50% rating and highly likely put on the temporary retirement list. From there you will be re-evaluated from time to time and in many cases the rating will be reduced from 50% to 30% or even worse 20% or below and then you could end up with the severence package.

how many year in do you have in, are you close to 20 yrs? can you make it to 20 yrs then collect CRDP from the VA.
 
Was this the MEB results, as in your local board/DAWG? I'm assuming so, and not actual PEB results because of the quick turnaround. I was told that the local MEB decision is hell to appeal, and you possibly have a long road ahead of you just to get to the PEB. Hope all goes well for you, hang in there.

Matt, all the advice you have recieved is good ..... don't forget the independant review.... which will give you more time for your rebuttal...... highlight a copy of your records, showing no "Treatment has successfully diminished or resolved the symptoms sufficently so that the member can perform the duties of his MOS at sea, on shore or in a deployed status, the facts of which are supported by the NMA.".... then provide that to the person doing the independant reveiw...... go from there. Contact your Ombudsman ASAP....... If the navy has them??? ;) GOOD LUCK

I currently have just over 8 years in service.

I thought this initially as well but the paperwork is from DC and says PEB on it.

I was given this option before the paperwork went to DC but the PEBLO made no mention of it yesterday. Could I just take my medical records to mental health and have an imparital doctor look it over?

Thank you for all the help, still a little confused but starting to get a plan together. My primary doctor has agreed to submit a letter and I plan on doing the same.
 
Do everything that you can to help yourself, it's likely you doc has access to your records electronically and may not need hard copies (it's a HIPPA violation to carry your records around.)

Request to have an impartial review through your PEBLO & JAG.
 
I have had bones removed and the VA contracted doc I got stated I was perfectly normal and in great condition, no bones removed and he recommended a psych eval stating I was crazy. Luckily for him I did and nope I wasn't faking and my military doctors had to write amendments stating the surgical notes, before/after x-rays... proving he is the one off his rocker. So definitely get a lawyer and fight; it even though it will be a pain it will be worth it at the end.
 
If you are at the PEB, the time for the MEB and impartial review has passed. But, you can continue to gather additional evidence.

You need to demand a formal PEB hearing.

I wonder what the MEB stated. If it states anything like the conclusions quoted by the PEB, you will have some problems. It seems like you are behind the power curve at the moment...were you not provided copy of the MEB before it was forwarded?
 
Bud it sounds like you have been taken advantage of....... you better start talking to some serious legal professional like Jason above....... good luck man :(
 
The highlights of the MEB portion are below. I was offered the impartial review but it was explained to me differently than it understand it now.

"...member being reffered to the PEB due to his inability to function at his current MOS".
"...member being reffered to the PEB becuase he would be unable to function in another combat tour."
"...criteria has been met for PTSD as well and panic attacks with agoraphobia."
"...current medications include Lexapro, Ativan, Klonopin, Trazodone, and Prazosin."
"...the degree of industrial, military and civilian performace is moderate".
"...medical board agress with the above findings and is of the opinon that the service member does have a pyschiatric disability that would render hin unable to perform further military service."

I tried to gather some information from SECNAVINST 1850.4E and DoDI 1332.38 but it seems very overwhelming. I plan to pull all of my medical records tommorrow.

Edit: I do have the MEB portion in hand.
 
WoW.... this reads like two different books (not chapters) :eek:, did you look in the name block to insure it's really your report :confused: .......... APPEAL !!! :mad:

Haha, that is verbatim on both reports. Not sure what happen either to be honest.
