  • Sir I understand you are an Attorney. I also understand you do not give legal advice in this forum. If you give me your telephone number may I call you concerning legal questions, when it is convenient of course for you, during your regular working hours? Do you still work as an Attorney Sir?
Hello Jason, I was placed on TDRL for TBI 70%,PTSD 50%, and headaches due to TBI 30% which gave me a combined rating of 90%. will I be re-evaluated on all three conditions in six months or just the PTSD? thank you.
If you're medically retired from the service can you still collect a severance package? I found something that said you could as long as your disabilities are service connected. Just curious if it's possible.
having a problem with getting my recorded corrected. my recorded it says I had meningitis when I was younger, that's all fine and good to go and I got a waiver to join. But now one doctor tried to contact my epilepsy to my meningitis when I didn't have a seizure until 3 years after I joined. are they going to try to find these 2 things before service? I am worried they will try to say epilepsy was prior and it WASNT.

Not sure what they will or won't try to do, but, the presumption of service incurrence can only be overcome with "clear and unmistakable evidence." That term means that the evidence must be undebatable. An extremely difficult standard to meet.
Recently i had my rating returned with AF 10% and V.A 100%. My attorney advised me that i agree to submit advanced ajudification because a disability that was given the highest rating possible by the V.A wasnt originally submitted to the AF on my Narsum. Do you know how long it usually takes to get turnaround on an answer from the formal board.
He did submit this to the board, jusy curious on turnaround time. If this doesnt work i have no desire to wait to see a formal board.

Turnaround for Advanced Adjudication is usually a few days at most. Like everything, facts and circumstances rule the day and if they are in the weeds at the board, it could be longer. I have had cases where I submitted the Advanced Adjudication memo well in advance and it was not ruled on until the day of the board. Most times they will do it faster.
    Good luck!
I was always told not to include my VA disability pay as income. What do I do for FASFA? My oldest filled out her own and never included it. I tried to include it for my #2 but it would not accept it stating it was an error. I believe it was because of my #1 child's application. What do i do in the future?

I cannot say for sure what the right answer is (especially without specifically researching the question). However, this site states that VA disability should be reported as untaxed income. http://www.finaid.org/military/vedbenefits.phtml I would check with your school's financial aid office.
Where can one obtain the specific legal criteria used by the PEB in deciding whether a mental health condition(s) meet the threshold of PDR so that a TDRL is not designated? Does the law require the PEB keep a soldier TDRL once it determines a mental health condition is the cause of medical discharge so that it cannot waive the TDRL and go straight to designating a PDR based on psychologist’s evaluation?

Best to post a separate thread about this question. I can't answer and really give a full response on a profile post.
Jason do an article on the Veterans only PTSD and addiction Treatment Center.
The owner Sebastian was very kind and told me he would pay for my flight. He turn a luxury hotel into a veterans treatment center. CHECK THEM OUT> VERY COOL TREATMENT CENTER

I was put on TDRL back in July 2008. I never heard anything from anyone so I contacted Tinker AFB which I contacted them 2 months prior to my 5-year mark. They were able to set up a date for my evaluation. Now I was told I was dropped from Tricare until they determine if I will go to TDRL or not. Any help or advice you could give me? Thanks.
Retired chapter 61 in 1995 at 50%. gross military pay is $952 (high 3 $1904?). Med retired at 8 yrs of service for PTSD. Rated by the VA at 30% (combat related) + 10% + 10% (not combat related) total VA rating=40%. VA waiver is $654.12(self/spouse). I believe my CRSC rating to be 30% ($456.97) and my retirement based on LOS to be $380.80 Do I qualify for any CRSC pay or will it still be at zero? Thank you
I recently enlisted and am in DEP. In the process of putting down 5 jobs i could only find 4 that i was really interested in, so my recruiter told me to put down Fuels, and he hyped it up a lot. so i did for some reason, not thinking about actually getting put into it. but i did. when i asked my recruiter if i could switch he said no. but when i looked online some said its possible. so which is correct
Mr jason good morning I have a really
    Important question

I just receipt my 199 back from my IPEB i was 80% army 100% i havent sign my 199, but i have found with cancer? What is the step to follow? I am confuse with all this part . Please help me thank you
    Jason Perry

First, I would consider whether your IPEB finding was PDRL or TDRL. If PDRL, the addition of another condition (cancer) would not seem to matter. If it matters, I would ask for a FPEB and fight the issues.
So I recently received my LOD back from NGB and it came back as not in the line of duty- not due to members own misconduct. I developed type-1 diabetes while on active duty in the Air National Guard and my medical squadron did an LOD for me. Well this LOD took about 8 months and I got it back as NILOD. And I have no known family history at all with diabetes. Does this sound right at all?
I received a permanent profile (P2) for sinusitis and awaiting one for my back (involved in a vehicle accident in basic training and 1 in Afghanistan, went to TMC but did not get LOD). My BN Medical Readiness NCO states she will send up paperwork to a PA for P3. I am being told without a LOD for any of my conditions this will turn into a PEB and I will be medically discharged.
