mac,
I've read your posts from 2015 and comments in 2017. I wanted to run my case by you as I believe that DA PAM 635-40, 3-12 will make my 20 years in June of 2022.
I was in the National Guard from 18 FEB 2000 - 30 APR 2003. My NGB 23 shows 152 AD points and 169 IDT & Membership points. All years were good years as shown on my NGB 22 and 23.
I enlisted in the Regular Army on 01 MAY 2003 and have served on active duty since then.
My BASD was just calculated as 30 NOV 2002.
RSO has calculated my 1405 service Active Federal Service since my BASD + my 169 points which would make my 20 years 11 JUN 2022.
I have a DoD rating of 30% and was found unfit; VA 100%
The problem: is that RSO doesn't believe that qualifies as my 20 years and encourages me to extend until 30 NOV 2022. USAPDA said the service calculation is more of the RSO's lane and is requesting an extension until 30 NOV 2022. DFAS won't provide an answer until they have retirement orders. My PEBLO had no clue about DA PAM 635-40, 3-12 (neither did the RSO until I showed them).
I believe if I retire on/after 11 JUN 2022 that I will have my 20 years and thus 50% for longevity multiplier and be eligble for CRDP.
This all happened due to an error on my AIT DD214 from 2001. It was repeated when I entered active duty and repeated/duplicated again when I commissioned in 2008, and even repeated on my retirement orders (which were rescinded one week before I began terminal leave due to the error.) Since then I had my BASD corrected and have been trying to show that my 1405 service is counted towards my 20 creditable years due to I am a Chapter 61 retiree.
I am still waiting for HRC retirements to answer me, but since you have first hand experience, I wanted to see if you agree with me and what you did to get everyone to understand DA PAM 635-40, 3-12.
Thank you. Feel free to contact me at [email protected] if you'd like to receive and review my documents and the references I put together for RSO and USAPDA.
