PEB unfit for duty

Hello, this is my second time posting here.
I have a question regarding being found unfit for duty of the PEB board. If you are found unfit for duty, do you still have to do staff duties? My profile sates No PRT, No strenuous physical activity and must be located 60 mins away from medical facilities. I made contact with VA MSC and they informed me that my process is currently at RFD (Ready for decision). I am not sure if I am still required to do staff duties (24hours). Thank you.

If you are found unfit by the PEB you will be medically retired or medically separated from the military. The condition(s) found unfitting by the PEB will receive a disability rating. If the rating for your referred condition(s) are 30% or greater you will be medically retired. You will be medically separated if you If the rating for your referred condition(s) are 20% or less.

Thank you. But my concern is about staff duties in my command.

I'm not fully understanding what you are asking. Are you asking if you can be required to stand staff duty while you are waiting for the PEB to make a determination of fit/unfit? The answer to this depends on what your current profile allows or disallows and whether or not that conflicts with what is required of you while assigned staff duties by your command.

If you are found unfit by the PEB you will be retired or separated which means no staff duty. Once you are found unfit your command should not assign you staff duties because you will busy outprocessing.

If your profile states any limitation, like “requires 8 hours of uninterrupted sleep within a 24 hour period”, then no, you cannot do a 24 hour staff duty, but you can possibly be required to do a 16 hour staff duty. Your profile is what really tells the command what they can and cannot do.

I’m talking from experience here, because I made a soldier do guard duty because his profile said he couldn’t continually stand with body armor on. So I asked the doctor if he could sit in his body armor while doing guard duty, which I got a enthusiastic “yes” from the doc. So that soldier sat for the guard shift with body armor on, with orders to only stand up when required.

I would make sure I had an retirement/medical/out processing appointment scheduled everyday or be on leave to avoid being placed on duty.

The PEB determined that I am unfit for duty since July but still currently waiting for VA for the proposed rating but I am found unfit. If I am found unfit but still no proposed rating, can I start outprocessing? Thank you very much

You normally can start out processing when you receive your retirement/separation orders because the orders will have your NLT retirement/separation date (90 days).

From who am I gonna receive the retirement/separation orders? Also can I receive the orders without the proposed rating from the VA? Because my PEBLO only told me about the PEB’s decision of me being unfit for duty but I haven’t heard anything about retirement/separation orders. Who should I contact to ask about it? My command has no idea about PEB and MEB processes. Thank you very much.

After you get your ratings and the PEB signs off on your DA 199 (if Army) and your agree with it and sign it, then your retirement (DOD 30% or above) /separation (DOD 20% or below) orders will be processed by your current/nearest IMCOM (Garrison) Military Personnel Division (MPD) and then you should be able to schedule all the required briefings to outprocess.

Your PEBLO is the POC for your 199 after the ratings are received.

The VA decision was made but I can't contact my PEBLO. Is there anyone else I can contact for DA199?
