Military Reserve Technician going through IPEB then disability through OPM/HRO

Do Military Reserve Technicians follow under regular DSR or are they under Chapter 46 for a disability retirement? My HRO seems to think that just because I bought back my 8 years of active duty and combined with my 12 years as a technician that I fall under the DSR condition for an annuity. I saw the Chapter 46 special rule for Military Reserve Technicians and it stated to be at least 50 years of age and 25 years as a dual status technician. I don't meet that condition either which enables me to file for a disability retirement as that is what im going through on the military side. Any definite answers are greatly appreciated. seems like HRO is trying to put me out on the Cheap and not letting me file for disability.

Did you contact army benefits center civilian? Also, to help you out what a regular tech retirement pay and DR pay would be is to check your EBIS. It gives you an estimate. Mine was almost on point. I made more on DR than a regular retirement if I stayed till 62. I’ll send the link of ebis when I find it.
 
Try this website, type it up. Once in that page look at retirement section and compare the differences in pay. Also, start getting copies of your SF-50 as it will be hard later down the road.

I just called ABC-C and they said that if your a Military Reserve Technician (dual Status MRT) and was hired after Feb 10,1996 the only way you can early retire is being 50 years of age and working as dual status technician for 20 years ( no military buyback counts towards 20 years) that means butt in seat working or any age and 25 years as a dual status technician ( no military buyback counts towards 25 years), this being a special provision for just Military Reserve Technician, Discontinued Service (DSR) does not apply to Military Reserve Technicians. DSR applies to those that are not in a dual status role or those who have to have military membership in their positions. So if you do not qualify to hold your military due to a medical condition, and do not qualify for a early retirement under the Title 5 U.S.C. 8414(c)(1)or(2) Early Retirement, then you would file for a disability retirement and even then if you don't qualify for that through OPM and get a denied response then you would file under the special disability provision for Military Reserve technicians called Public Law 97-253 and then your pretty much confirmed that you will receive your disability.
 
Okay, here is a question. What is the special rule for military reserve technicians that are 50 years of age and have 20 years of (in SEAT service ...no military but back time) or any age and 25 years of (in SEAT service ...no military but back time) used for? It looks as if the OPM will put me out on a DSR since I qualify for an unreduced annuity since i will be 55 years old and have of 20 years of service that includes my military buy back. When is Public Law 97-253 come into play or does it even come in to play in my case? Can I file for a Disability Retirement after being released from civil service with a DSR?
