  • Hello Mr. Perry I have a unique situation for you or anyone that can give me some advice, did 15 active, currently in the ARNG of 3yrs & receive a combined 100% SC rating. Was recently given a P-3 for MH issues, had my records reviewed by the NG Dr. who reported I will have a PEB, (70% mood disorder). No LOD was given, can I be given A MEB or PEB discharge only with no Benefits?
    I am considering a career change. I am an active duty major, with 14 years TIS and 3 years TIG. I am planning on reverting to warrant officer to finish out my career. It is likely my rank when I apply for retirement will be CW2. For decision purposes, what would my High three be based on, and what should my retirement rank be?
    If i was prescribed a service dog for my PTSD and i am found fit for duty by the board will they take him away/ limit him from me? I am Active duty Navy going up for Post traumatheadache, transit alteration of awareness, MTBI, post concussion syndrome, PTSD, insomnia and Si joint disfunction and sacrolitis

    Unfortunately, the Military does not currently recognize "Service Dogs" for PTSD or other MH related issues. Therefore a board's findings would be irrelevant. One more reason to contact your Congressional representatives and urge that the VA and the DoD recognize the benefits of Service Animals outside of major physical disabilities, as the ADA currently provides for! Lets get this ball rolling!!

    I am running into a confusing situation. I am on the dual status disability retirement (60/40). I have an opportunity for a job driving for a local company making between 30k-35k a year, well below the 80%. Question is, i am a CDL holder, have been for 10 years, will OPM take my annuity if i drive. I am so confused and need some help....OPM nor anywhere else has good info....everything is too vague. thnx
    I am in the MEB process and I have not been paid for my visits there is a lot of confusion on how one gets paid. Is there on person that is responsible for the orders? My unit says it is not their responsibility, the PEBLO say the same and finally MEDCOM says "not Me". Any advice?
    My orders states reason: medically disqualified, not result of own misconduct, assigned to: The Retired Reserved. I have less than 20 years but more than 15 years of service (14 AD & rest reserve). Will I receive the 15 year letter or does my orders need more info on it? I retired in 2003 but now am trying to get my paperwork in order, after reading some of the questions on here, getting a little nervous.
    Can the evaluation board make a fitness determination based on how the condition is projected to evolve over the course of time, or do they have to make a ruling on a case based on what it is at that moment?

    Hard to say without knowing more. I don't know enough about your case and your situation to hazard a guess. Also, not sure what your goals are. Might be better if you post a thread discussing your questions and the facts of your situation. Best of luck to you!

    Hello Sir,
    I just left my Pen and Comp exam. Not sure if you have an answer for this. Injured my back in Iraq in 09. Minor injury. Well I thought. Fast forward, several years, x-rays show arthritis in my low back and a convex in my spine. I had about 50 degrees forward flexion and 15 side to side. Overall I have a high tolerance for pain but I’m in pain daily. Could I get a rating? More I read more I’m confused.

    Hello Jason, I was placed on TDRL for TBI 70%,PTSD 50%, and headaches due to TBI 30% which gave me a combined rating of 90%. will I be re-evaluated on all three conditions in six months or just the PTSD? thank you.
    If you're medically retired from the service can you still collect a severance package? I found something that said you could as long as your disabilities are service connected. Just curious if it's possible.
    having a problem with getting my recorded corrected. my recorded it says I had meningitis when I was younger, that's all fine and good to go and I got a waiver to join. But now one doctor tried to contact my epilepsy to my meningitis when I didn't have a seizure until 3 years after I joined. are they going to try to find these 2 things before service? I am worried they will try to say epilepsy was prior and it WASNT.

    Not sure what they will or won't try to do, but, the presumption of service incurrence can only be overcome with "clear and unmistakable evidence." That term means that the evidence must be undebatable. An extremely difficult standard to meet.

    Recently i had my rating returned with AF 10% and V.A 100%. My attorney advised me that i agree to submit advanced ajudification because a disability that was given the highest rating possible by the V.A wasnt originally submitted to the AF on my Narsum. Do you know how long it usually takes to get turnaround on an answer from the formal board.

    He did submit this to the board, jusy curious on turnaround time. If this doesnt work i have no desire to wait to see a formal board.

    Turnaround for Advanced Adjudication is usually a few days at most. Like everything, facts and circumstances rule the day and if they are in the weeds at the board, it could be longer. I have had cases where I submitted the Advanced Adjudication memo well in advance and it was not ruled on until the day of the board. Most times they will do it faster.

    I was always told not to include my VA disability pay as income. What do I do for FASFA? My oldest filled out her own and never included it. I tried to include it for my #2 but it would not accept it stating it was an error. I believe it was because of my #1 child's application. What do i do in the future?

    I cannot say for sure what the right answer is (especially without specifically researching the question). However, this site states that VA disability should be reported as untaxed income. http://www.finaid.org/military/vedbenefits.phtml I would check with your school's financial aid office.
    Where can one obtain the specific legal criteria used by the PEB in deciding whether a mental health condition(s) meet the threshold of PDR so that a TDRL is not designated? Does the law require the PEB keep a soldier TDRL once it determines a mental health condition is the cause of medical discharge so that it cannot waive the TDRL and go straight to designating a PDR based on psychologist’s evaluation?
