    Telephonic fpeb

This is a critical piece of information considering how hard it is sometimes to get an FPEB when found fit. I hope you hear something soon.

Need help — Serious problem with IPEB results...

You totally lost me with that last nonsensical post. I thought you said in the OP that you were found unfit for the ankle condition. At 10% DOD? I don’t know how better to explain to you that being found unfit by the PEB doesn’t mean that all conditions will be found unfit. It means that at...

Need help — Serious problem with IPEB results...

You seem very frustrated - that energy would be better utilized educating yourself in my opinion. Where did I state that I felt the PEB was correct or incorrect in their findings? What I, and others here, have told you is that the PEB makes fitness determinations based on medical...

Need help — Serious problem with IPEB results...

Again, you are confusing the concept of meeting a medical standard with the concept of fitness for service. One is a medical process, the other is a personnel action. You stated “What this looks like to me is the MEB uses an actual regulation to determine whether a condition is fitting or...

Need help — Serious problem with IPEB results...

Some semantics that are driving me crazy: the MEB does not determine fitness. They review a condition and render an opinion regarding the medical retention standard. A condition either meets or does not meet the medical retention standard (in OP’s case, IAW AR 40-501 Ch 3.) The PEB determines...

    Can I appeal Unfit?

You have a right to appeal an Unfit decision, in other words you can "'non-concur" and demand a formal PEB (FPEB) if found unfit. You do not have a right to an FPEB if found fit, but may request one. Source: AR 635-40.

Being sent straight to LDES as AGR soldier?!

PM me your email address and I'll send you the applicable AGR regulation. Your Soldier can take that regulation directly to his CoC to educate them (there's an art to this), or you can just have IDES legal take care of it. LDES is voluntary, requiring the Soldier to waive IDES, a signed memo...

    how long will i wait

I have a fact, a recommendation, and a speculation for you, in that order: Fact - Only the service member can waive the right to IDES enrollment. Period. Up until last year I was involved in hundreds of these boards annually. Recommendation - Recommend you discuss with IDES legal, then...

    Unfit Memo

Joe, are you on a government computer? All MODS applications are still restricted to government networks (they had a hacking problem a few years ago).

Conflicting info on P3 profile "diagnosis"

I made an error - “unfitting” should say “potentially unfitting”. The MEB (a medical process) does not determine fitness, they just provide an opinion regarding whether or not a condition meets the medical retention standard and therefore the SM’s case must be evaluated by the PEB.

Conflicting info on P3 profile "diagnosis"

Being referred to IDES for a single condition isn’t an issue (and is common). You only need one condition that requires MEB evaluation (in your referring provider’s opinion) in order to start the process (initiation phase) Once you have a second signature on the P3 and are in the MEB phase, all...

Conflicting info on P3 profile "diagnosis"

Hi! During the MEB phase, the IDES provider reviews all current conditions and provides an opinion regarding whether they meet/do not meet medical retention standard. Note that this is not the same as fitness, which is a personnel decision. The MEB provider writes up a narrative summary (NARSUM)...

    LDES (LEGACY) My Navy Timeline

Caveat: this is not legal advice or advice of any kind - this is me thinking out loud in response to your question: Inspector General - paraphrasing their mission statement, they investigate allegations of misconduct, typically regarding complaints of FWA that violate rules and regulations. In...

    LDES (LEGACY) My Navy Timeline

Hey ZG, I have nothing to add other than I am still in that same boat (little Navy pun for you ). - to MEB in December - Condition did not meet retention standard (still DEC), referred to PEB - 3+ months later, still no word from PEB regarding fit/unfit despite single referred condition with...

    Coronavirus and the PEB

I'm an LDES case and have been waiting on a decision from the PEB since February... For a single referred condition. I think the next step for me is going to be IG involvement. According to the San Antonio office I called two weeks ago, IPEBs are still being conducted.

    Appeal process

Simple answer as someone who deals with DES nearly every day - Because the severity of a disability is not necessarily related to whether or not it makes a service member unfitting. For example, conditions requiring biologic therapy (such as psoriatic arthritis) are not necessarily disabling...

    Appeal process

I’m... confused. Is your T1DM or related complications disabling? The standard for 30% (assuming that’s your P3 referred condition) is relatively severe compared with some other conditions. How long have you been active duty? The few T1s I’ve referred to DES ended up being (appropriately) EPTS...

Chapter 5-17? or Fight For MEB?

Oh, didn't see your other question. Just google IDES (integrated disability evaluation system) office at your local installation. There should be a contact number. If you tell me which post you're at I can provide the number.
