On August 5, 2014, the Department of Defense issued three important updates to the Disability Evaluation System regulations (the first was the issuance of DoDI 1332.18. Along with this, the DoD Manual 1332.18 Vol.1 and 2, were released).

I will be posting further comments on these issuances. There are some important policy updates along with cancellations of other regulations contained in these issuances. The new regulation may have a significant impact on current cases, so it is important to understand how this may impact your case.

I have only reviewed DoDI 1332.18, and have not gotten through the Manual yet. I am posting this now so that it is immediately available. You can find these issuances in the Resource section of this site. Here are the specific links to the resources:

Do these new updates also have any impact on those currently under TDRL???

Yes, all three issuances have section that reference TDRL members.

I've been reading through these as well. I'm looking mainly for situation involving non-duty DES since I'm still deep in that whole thing. Ick.

One important issue to note from DoDI 1332.18 is the references section of the instruction. It cancels several key regulations that previously governed the disability evaluation system.

Here are a list of the important changes:

  1. DoD Directive 1332.18, “Separation or Retirement for Physical Disability,” November 4, 1996 (hereby cancelled)
  2. DoD Instruction 1332.38, “Physical Disability Evaluation,” November 14, 1996, as amended (hereby cancelled)
  3. Under Secretary of Defense for Personnel and Readiness Memorandum, “Policy Guidance for the Disability Evaluation System and Establishment of Recurring Directive-Type Memoranda,” May 3, 2007 (hereby cancelled)
  4. Under Secretary of Defense for Personnel and Readiness Memorandum, “Directive-Type Memoranda (DTM) on Standards for Determining Unfitness Due to Medical Impairment (Deployability),” December 19, 2007 (hereby cancelled)
  5. Under Secretary of Defense for Personnel and Readiness Memorandum, “Directive-Type Memorandum (DTM) on Implementing Disability-Related Provisions of the National Defense Authorization Act of 2008 (Pub. L. 110-181),” March 13, 2008 (hereby cancelled)
  6. Under Secretary of Defense for Personnel and Readiness Memorandum, “Policy Memorandum on Implementing Disability- Related Provisions of the National Defense Authorization Act of 2008 (Pub. L. 110-181),” October 14, 2008 (hereby cancelled)
  7. Under Secretary of Defense for Personnel and Readiness Memorandum, “Policy and Procedural Memorandum for the DES Pilot Program,” November 21, 2007 (hereby cancelled)
  8. Under Secretary of Defense for Personnel and Readiness Memorandum “Policy and Procedural Update for the Disability Evaluation System (DES) Pilot Program,” December 11, 2008 (hereby cancelled)
  9. Under Secretary of Defense for Personnel and Readiness Memorandum “Cross Service Support and Service Organization Role at Disability Evaluation System (DES) Pilot Locations,” March 29, 2010 (hereby cancelled)
  10. Under Secretary of Defense for Personnel and Readiness Memorandum, “Directive-Type Memorandum – Integrated Disability Evaluation System,” December 19, 2011 (hereby cancelled)
In any appeals, rebuttals, or submissions, members should refer to the new regulation in lieu of citing the now cancelled references. (On the other hand, recall the effective date of the new regulation is August 5, 2014. For cases completed prior to this date, reference should be made to the regulation in effect at the time of the challenged action).

It is like the GOV wants to make this process as confusing as possible and as soon as Veterans actually start understanding the rules of the game, the rules are changed. It reminds me of shopping at big box stores. They redirect you and confuse you by moving things around about every 3 months. This makes you shop more by directing you down a path you would have never gone. -- Same with the IDES process. You actually figure out the MAZE, and BAM, they change the path.

Do these changes have an effect on those who are already permanently retired?
