Can I make another case with the BCNR despite my discharge already upgraded?

Even though my re4 code and JFV got changed to a RE3G and JFF I’m still having issues finding a recruiter whose willing to help me re-enlist. The fact that I need a waiver is scaring a lot of people away. Also for some weird reason the Air Force reserves is telling me that my re code is non waiverable. Is there a way I can resubmit to the BCNR to try and get a RE-1?

Answer: It is possible to appeal decisions of the BCMR or the DRB in federal court under the Little Tucker Act or the Administrative Procedure Act. This publication does not explain how to appeal.
If you want to get access to VA medical care or disability compensation, you can skip the Discharge Upgrade process and instead request a characterization of service determination from the VA itself.
