Can my doctor force me to see the specialist of her choice?

For reasons I don’t want to go into, my unit’s doctor has told me she does not want me to see my civilian specialist. She would like me to see a specialist of her choice, based at the local military hospital. She even made an appointment for me.

if I cancel this appointment, is it possible I will can be disciplined or receive non-judicial punishment?

You are asking a legal question. Ask an attorney. Get the JAG to discuss this with you.

Personally, I would cancel the appointment, but that is NOT legal advice.

I am not an attorney or an attorney spokesperson.

Pretty loaded question "for reasons I dont want to get into" but unfortunately that does matter, if the doctor is wanting a second opinion they can request that all doctors and agencies can request second opinions albeit its usually for very complicated cases. What you can do is ask your doctor to specifically state in writing why she believes that the civilian specialist diagnosis, treatment, recommendation, opinions etc lacks merit. If your specialist came to conclusions without appropriate testing that could be why she is requesting an on base doctor. It is most likely in your medical records why she is pushing this or disagreeing with the off base provider have you started there?

Read and know the DoD patient rights. Also providers must maintain their license, which means they must follow the requirements of their state licensing board and the code of ethics of professional associations.

You have some very good points. I don’t want anyone to recognize me on a public forum, hence me not wanting to go into details. I just wanted to know if I cancel an appointment whether I can be disciplined/get in trouble. Thank you for your time.

My doctor claims that she needs me to see a military specialist because she needs to make military decisions such as fitness for duty or being on a profile which my civilian doctor can’t do, as one of the reasons. However, I don’t see why my civilian provider can’t make suggestions and she can make the decisions herself.

In my opinion your military Dr. is full of shit. Civilian Doctors can give their opinion on such things. Know your rights and don't be bullied into a decision if its not in the best interest for your health. I have known way too many people broken by our military's medical community. Military doctors are humans too. They can be biased and make mistakes so don't be afraid to know your rights and to seek the medical care you deserve.
