Aloha,

Forgive me if this isn’t the correct space for this Question, I have some difficulties due to combat wounds.

Injured in Afghanistan awarded PH 2011. Placed on TDRL in 2011, medically required PDRL 2013 as an E4 with 5 years RA. DOD rated me 70% at the time. VA rated me 90%, which increased due to error in calculation/determination to 100% in 2023. Applied for CRSC in 2023 awaiting DOD letter should be end of MAY. After research I am expecting zero from the DOD, outcome being I am entitled but the entitlement is zero. However, further research CRSC eligibility started for me before the 2013 law? Sooo now I am not sure. I am sure that VA pays more than the retirement I would have received without waving military retirement. So nothing? Thoughts on this.

My first CRSC check was March 2024. Retired in Sept 1981. Am I entitled to retroactive CRSC pay to year 2003? If so, what should I do to claim it?

By law the maximum they can do backpay is 6 years. There is nothing needed for you do to to receive backpay. When my wife was approved for CRSC she was due 3 months backpay. She got it 6 months after CRSC started. If you are entitled to years of backpay it will take longer for DFAS to process and pay it. No clue on how much if any backpay you may be entitled to but if you read the statue of limitations statement for CRSC it will help you determine that.

Here is the statement about backpay which is listed on the award letter for the Army though this applies to all branches:

Six Year Statute of Limitations: CRSC is subject to the 6-year statute of limitations, 31 U.S.C., Section 3702(b). In order to receive the full retroactive CRSC entitlement, you must file your CRSC claim within 6 years of any VA rating decision that could potentially make you eligible for CRSC or the date you become entitled to retired pay, whichever is more recent. If you file your claim more than 6 years after initial eligibility, you will be restricted to 6 years of any retroactive entitlement. Any questions relating to the payment of this claim must be addressed to DFAS, which serves as the payment authority for CRSC.
