Entered PEB and Asking Questions

Hi Sir,

I entered PEB on 1AUG for PTSD/ TBI (not combat related), chest wall injury (service connected), chronic low back pain, and migraines. I have requested to remain in service, but my command will not allow me to return to work or approve me to obtain any type of home health services, so I have been sitting in limbo trying to figure out what I am to do.
Do I start looking for work outside of the military or continue to request to stay in? The attorney stated that if I request to be found fit, I will be hurting myself with the IDES process and it will only take me to my reenlistment. My EAOS is in 6 months. Am I allowed to even work while in this process? I'm not getting the treatment I need and the command is pushing off providing any assistance or answering my questions regarding working, school, programs, etc.
What's the process from here?

You should not try to stay fit as that will hurt you. You should accurately describe your conditions and not sugar coat your symptoms. If the unfitting conditions are rated 30% or higher you get medically retired which is huge because you can get Tricare insurance for life and if you choose Tricare select the annual enrollment fee is waived for medical retirees.

I would consult your IDES attorney throughout the process or higher dedicated private one. Now is not the time to focus on getting a job but rather learning everything about the IDES process and focusing on your health. The benefits value for medical retirement and VA compensation far outweighs any salary you would get from a job when you get out. Once you get this all squared away you can then focus on employment after military life.
