Just Received Narrative Summary

Team,

I just received my narrative summary and my PEBLO is telling me to expect a severance and a couple of friends that manage MEBs for the Army told me I am getting railroaded; they basically told me to plan to fight. I currently have 15 yrs and 6 months of service and am being put out for torn tendons and labrum in right shoulder (dominant arm). I have had two surgeries and the second could not repair the issue, Civilian Ortho has said my shoulder needs to be replaced. I brought the notes to the PCM and he put me in for a MEB vs approving a shoulder replacement.

My narrative summary has come back with only one ailment not meeting retention standards, my shoulder. Again, my PEBLO told me to expect 10-20% because its only one ailment which does not meet retention standards. I am just struggling to believe that my right shoulder could not get a higher percentage (one that's enough for a Med Retirement, especially since my shoulder requires a replacement surgery. I am attaching a copy of my DA 3947, the narrative summary about my shoulder, and the VA examine of my shoulder (I can provide more if need be).

Again, I have 15 yrs and 6 months of service. I feel like I have a lot to lose and I'm just being tossed aside. I am just reaching out for any help (I was given 5 CALENDAR days (so due by 25 APR) to either conquer or not conquer and they drop this on me on a Friday afternoon).

You need to do a rebuttal and or IMR. I would hire a private attorney. You are still early enough in the process to turn this around by working with a competent private attorney.

Any recommendations for legal counsel?
Sent you message offline. Did you get it? My wife used a private attorney and fought through the entire thing. She had 17 years AFS and was going to get screwed. Instead with the help of an attorney, sound strategy and hard work she maximized her benefits.

I got your message thank you. Put a call out to both.

Yeah man, that is what percentage I got on mine. Same situation. Two surgeries plus a bicep and the need for a replacement.

Did you get a lawyer to help you out or just ride the lightning? Did you contest for a Formal PEB?

I just have trouble throwing almost 16 yrs away because of this. What makes me mad is the PCM put me in for the MEB when he saw the Ortho say replace shoulder and the replacement would of still got me an MEB but at least hit 30%.
