LOD for Multiple Sclerosis

I am currently in the Air Force Reserves, and have been in the AF for about 7 yrs. Most of my time in the Reserves I have been on active duty. I recently returned home from Afghanistan and am now on active duty once again. I have as of March been diagnosed with Multiple Sclerosis. No one in my family has EVER been diagnosed with this and after investigation I have found that the VA considers this a service related disability. The active duty doc that I have been seeing said that from what she had seen I would be retired due to combat for this disease since it is considered service related. I am now hearing that the Air Force Reserves are possibly not going to approve my Line of Duty as there is disagreement as to it being service connected. Is there anything I can do if this gets disapproved?

First thing would be to appeal the Line of Duty Investigation. If they deny you, they have to do it through a formal investigation. This is one of the worse executed parts of the system as the investigating officers are not well trained (they get a briefing and have the advice of a legal officer, but I see way to many clearly wrong determinations). Good news is that if your case is clear (sounds like your is, but would want more details to know for sure) you can win this fight.

Any help would be greatly appreciated! I am soo confused about all of this. What information would you need to know? Ask me anything and I will share! Also since I have been on Active Duty for over 6 months don't they have to treat me like an Active Duty member, and if so how does that change things?

If you are on orders that state 30 days or more, you are treated as active duty member.

I suspect you will be fine, the presumption is that your condition is incurred or aggravated by your military service. They have to show evidence of a generally accepted medical principles that your condition was not and I don't think there is any way they can do that. You should be fine, ultimately. However, this assumes they process your case correctly. If they do not, you will have to fight this issue, but again, from what you have said, I think you prevail.

Man I sure hope it all works out! If not and I get disaproved then I will be going to war agian. Only this time against the system!!!!

I got diagnosised with this in April by the Active Duty Neurologist and have been and will be on orders until Sept... I was also on orders for about 2 years before this that ended last Sept and only off orders from then until March...

What else would you need to know inorder to help me? I am sooo confused about all of this!! Also I was told before the whole LOD issue that I would probably be medically retired. Is this true?

I am in the same boat, sort of. I was in Afghanistan for over 6 months and ended up with either MS or Transverse Myelitis. That is yet to be determined. Either way, I was wondering what the end result of your MEB/PEB determination was???
 
Can anyone advise me of their outcome? I am a reservist who was activated and was diagnosed with MS in Qatar. My unit is currently disapproving my LOD and stating MS was in my genes and it was not service aggrevated.

I see this is an older thread, but is anyone still around here that can provide an update to their status/cases? Ckin843, can you update what's going on with your case (if still around)?

@Jason Perry - this is a very old post, but I am currently in the same situation you commented on here: I am facing a Flight doc denial of LOD due to him stating my condition was incurred at birth, not that it was aggravated by my military service! He has not shown any evidence of medically accepted principles, only stated that I "was born with it". He cannot specifically say that with any proof, but I am on the other side probably going to have to get this into a Legal type OAC scenario, which I am dreading the ridiculousness that ensues with that.

I actually printed out these two pages to show my commander, who in turn emailed the Flight Doc to ask why I did not ever get an LOD started on my case at the very beginning? That is when the flight doc responded with "I was born with it". I am planning on having my MS specialists draft up a letter to explain the facts, not his hearsay.
