so when i did my C&P exam (sleep study) at home they shipped me this little device to put on my middle finger and when the results came back the test was negative, yesterday i got my DA3947 for me to sign before they send the document to the PEB and i noticed that on the list of my conditions sleep apnea was not listed no more as my initial conditions for VA claims; so to tell you a little be on the background in the middle of my MEB process i have undergoing medical appointments and one of them is treating my sleep issues so i was referred to a off post clinic to perform a actual sleep study where they diagnosed me with OSA; i got the results on paper, went to the IDES building and told them to upload it as evidence so they can see it there when they review my medical records... so to me is clear that they did not noticed the new sleep study results document on their files, or they just stick with the first negative results, so my question is should i appeal that now so they can review again and find my actual diagnosed for OSA or should i just keep going on the process? because that's another thing now... im worried that the VA also don't have position of this new diagnosed and don't give me ratings for it.

if not the unfitting condition you can add OSA after you get out. My wife just did that. If they rate you for it but give you 0% you can appeal and show the sleep study. Things that come up during IDES that are not unfitting are best to be dealt with after you get out.

thanks, i will have a legal review next week i gotta see what they said about it
 
An Obstruction Sleep Apnea claim with the VAcan be filed using the Fully Developed Claim method, once you are no longer on AD.
