Is there a way to challenge an ND-PEB? ARMMC says my conditions are not Duty related, but I disagree. I’m worried about the long term affects of what might come from this. Any input, suggestions or ideas?
I don't see how you would get it changed. I don't see a way to get this added. Bipolar conditions typically aren't service connected or result in LOD which determines that your condition was caused due to military service or aggravated due military service. So I do have an LOD for this condition...I have multiple MH diagnosis that fall below the retention standards of the army according to AR40-501 Chapter 3-33. Bipolar and Anxiety Disorder. Basically, they have send me to ND-PEB for my Bi-Polar but they said that since I don't have any treatment records for my LOD while on active orders that I don't qualify for a normal PEB.
I definitely get that. I'm not trying to get my bipolar service connected. It's the anxiety for which I have an LOD for that also falls under retention standards that I'm trying to have sent me to MEB/PEB.I don't see how you would get it changed. I don't see how that gets added either. You say you have a LOD for anxiety. Did you receive treatment while on orders or drilling? Go to the hospital? Even if you did those things it would be a long shot because the Army Reserves will state that the condition existed prior to the event. Don't have to take my word for it. Go talk to JAG or consult a private attorney and see what they say.I definitely get that. I'm not trying to get my bipolar service connected. Oh, I believe you. I guess I'm getting the VA rating system and the PEB confused. So the VA will say that they made my condition worse but the DoD doesn't care? I actually ended up going to the emergency room while at drill for what appeared to be stroke like symptoms. Thats when they gave me the LOD for anxiety.I don't see how that gets added either. I am not saying you don't have a chance but its a long shot. The USAR is going to say that anxiety started prior to drill and that it is a pre existing condition. Not a brand new one caused by an event that occurred while on drill or active duty status.Oh, I believe you. I guess I'm getting the VA rating system and the PEB confused.
