I received my PDBR results last week. They rated me 20% under the closest code they could find for my bilateral plantar fasciitis post surgery. Today I found out that the VASRD was updated to include a code for plantar fasciitis.

“ 5285 Plantar fasciitis:

No relief from both non-surgical and surgicaltreatment, bilateral30
No relief from both non-surgical and surgical treatment, unilateral20
Otherwise, unilateral or bilateral10”

I had surgery with no relief so it should have been rated at 30%. Would an appeal be possible based on this? Thank you!

What would be lost by appealing? I don't see a downside.

I have to appeal in Federal court. I have no experience in federal court. I’ve being using NVLSP during my PDBR process. If they don’t want to appeal, I’ll have to find a different attorney so it will more than likely be out of pocket.

I just didn’t know if anyone has experienced anything similar.

I understand your situation better now.
