PEB/VA ratings

I am active duty navy going through a medboard for MS. Signed narsum on September 8th and case was sent to Washington naval yards on september 14th. I received 30/90 proposed ratings about 3 weeks ago and just wondering if the PEB/VA are actually working together at the same time. I just spoke with the VA on the phone and she sounded clueless when I asked about the collatteral process with them and the DOD side. I'm sorry if this post doesn't make sense but just wanting to spark some conversation.

If you were speaking with a customer service representative through the main VA telephone number, that person might not have expertise beyond the script he/she has been provided.

Some of the many members of this board who have been through the process will probably provide a more thorough explanation.

The VA determines if a claim is service connected, if it compensable, and if so, at what rate. While many of their employees may know about the DoD process they are not specifically trained on that process. Nor is there any reason they should be. VA and DoD have separate chains of command, separate processes, and different missions.

In the current IDES process the VA provides DOD a list of the member's service connected claims and their ratings. If the PEB determines one or more of those claims are unfitting, then the PEB calculates a DoD percentage using the VA's assessment of those unfitting claims.

I suspect you have other questions. Please feel free to post those.

How soon after I am medically retired can I claim something secondary to my MS that has happened after my file has been submitted to the VA? For instance, after my new treatment for aggressive MS I've been dealing with sciatic nerve pain and the worse knee pain you could imagine. I'm 22 years old and walk with a cane some days. During my exams my MS was no where near this bad. And how do I get civillian medical records onto my medical records due to me being seen by UCSD for my MS.

How soon do I need to enroll in VA healthcare? I'm a few months from separation.

lots of questions. If you know anything about getting civillian medical records transferred to military records please let me know. ^^^

There is a way through the VA portal that you can upload additional documents into their system. Or you could go to your medical facility on base and request a CD with all of your medical records (ALTHA).
 
Also at the end of your IDES process there is what is called a VARR, VA rating review. When you reach that point, submit a VARR through your JAG attorney and include the additional evidence. Make sure the VARR is well written and it explains how the new evidence should result in a higher rating.

Immediately, try and get the sciatica and knee issue in your service treatment record prior to discharge.

VA Healthcare whenever you are discharged.

If you have civilian records you can directly submit them to the VA, or submit a VA Forms 21-4142/4142a to have the VA obtain them for you.

Would this result in another C&P exam or would they just go back in and adjust the rating based off of the new pain and symptoms I have been experiencing since then, possibly? I've been seeing a MS specialist at UCSD and have been trying to get up with him so he can talk to my neurologist at the naval hospital and transfer my "civillian" medical records over. Because that's the only proof I would have to help increase my rating with the VARR.

It will not trigger another CP exam. But the VA rater will look at it and adjust your MS rating. You can just get copies of your civilian records and give them to your PEBLO, but I’d also upload them to the VA to make sure.

Thank you! Does this look normal? I recieved my proposed ratings which I believe is why the top case is closed. Do you know if I will received my final ratings or my unfit findings from dod first? I know that it's being done together but I've talked to 3 or 4 people who said they got one before the other. Is it still taking the va 3-6 months to finalize rating?

First claim closed to send rating to DoD and provide you proposed VA ratings. Second claim opened to pay you once you upload DD214 or equivalent.

So that case won't close until I'm out of the military? Will I have to wait to hear my final ratings from my PEBLO instead of looking on ebenefits?
 
The second claim does not close until your DD214 or equivalent is uploaded. You will get proposed ratings from your PEBLO or the VA. The second claim closes quickly after your DD214 is uploaded.
 
If the medical team who initiates the MEB can only select one condition to have someone rated on, and the person has multiple conditions that could be unfitting, how do they prioritize which condition is unfitting. In my sons case they chose to just file the MEB for his POTS but not for his GAD as it is part of his POTS. Was this MEB initiated correctly?
