Promotion for combat disability medical retirement

New member here, I have 27 years in the Army Guard. I am going out on a medical due to 50% for PTSD and 30% for non combat related injuries. I am a 1SG and have completed all my NCOES requirements to include the Sergeants Major Academy. I am currently number one on the E-9 promotion list. I have read many laws to include 10 USC 1372, 1201, 1204. What I read is that out of AR 635-40 you can be promoted to Grade to which the soldier would have been promoted had it not been for the physical disability for which the soldier was determined unfit. AR 600-8-19 para 1-21 (f) soldier will be promoted effective on the soldiers separation date. Many soldiers that I know have been promoted on paper but not for benefits. I am told now that this no longer exists from a civ in San Antonio. Does anyone know if the Promotion will still take place? It means nothing to many but to at least have it on my ID in the end,means something to me. USASMA was not completely wasted. Thanks in advance to anyone.

You would get promoted if on the promotion list even if not promoted. This would allow you to be promoted on the your last day before your retirement. It wouldn't help you with your retirement amount since I am assuming you are high 36 which means the way retirement is figured out is totaling your highest 36 months of pay and then dividing it by 36 to determine the monthly amount to use. Then apply that amount times your longevity which is your points divided by 360 then times 2.5% or times your disability DOD%. You get whichever is higher.

He was on a current promotion list and was told that the Army changed the rules recently. He also had a civ from San Antonio that deals with disability tell him he could not be promoted. He said he would have had to had been chosen for promotion to actually receive it.

For officers you get listed on the promotion list so you are selected and therefore have been promoted. If you're talking about enlisted and being first on the list to be promoted but not actually being promoted then you are correct. Though just to get technical that wouldn't be a promotion list. That would be the list to be promoted LOL.

Ok, the list to be promoted….does it still apply? I was told that the PEBLO would want to see this list
 
I do remember reading another post a few months back about with a 1SG very similar as your situation. That 1SG was not promoted due to recent regulation changes. I also read the ALARACT or memo or whatever it was around the same time frame that explained the changes. Also Army Times had a write up about some of the changes.
 
I don’t remember exactly but the concept was that a soon to be SGM would not get promoted on the last day of medical retirement if that soldier was not already in a SGM billet.

I realize vague memory from me doesn’t help one bit, but I figured I would at least try to help.

Basically you need to be selected to be promoted to get that rank when you retire. My wife was picked up for Major. So she was promoted but there are sequence numbers so its possible to be officially approved for promotion but not get promoted before medically retired. That is when you get promoted on the last day.

Hey Top. So I wrote this in another thread as well but it can still happen. Get ahold of G1 on post or a retirement service representative. I am enlisted and was on a promotion list and got “promoted” my day of medical retirement. You need to get ahold of them now so they are on the same page. They will probably need to do the amendment after your date of retirement but it can be done.

I am not reserve so I cannot tell you the form number for the amendment but your ARA could know. G1 should definitely know if they are in the separations section.

What class were you in at the USASMA? I was in the resident course class 30 in 1987.

Hopefully this will be some use. But I had these same questions. I asked my PEBLO up front and she said “ The PEB won’t promote you unless you have been selected” which may or may not be true on their side. However my G1 was very helpful in putting in a revision. (I don’t know the form number) but basically that form that was turned in was what got me the updated rank.

Provis is correct. My name was on the list with a sequence number of 112, the list came out Thanksgiving week and I went in terminal leave Dec 15th. The people at retirement services office at FT Riley made my retirement orders double as promotion orders with my date of rank my last day of terminal leave 30 Jan.

If mr civilian gets in your way get your jag involved or find out who his boss is and go over his head.

Thanks, is there anyway you can acquire any of this information so that I may present this to our G-1?
 
I’ll have to track someone down at G1. In the meantime I would ask retirement services as well. They talk to G1 all the time. But I will try to locate that and send you a redacted copy in a PM
