Hi folks. I couldn't find an answer so I'm posting. Currently I just got done with the VARR stage and going to get my packet finalized. I have a COAD approved by my TAG so I'm good to go there. My question is when I re-enter the IDES 6 month prior to retirement will I get the chance to get my packet fixed with new C&P exams or should I submit a NOD now? I currently have new knee injuries and in regards to the VA they didn't rate my knees when I initially turned in my claim for knee pain. I'm curious if I go back into the IDES that I will get the chance to redo my claim so this is covered?
AGR (w/1405 Days I'm at 17yrs AFS). I have 23 years total service.
Sep 2016. IDES Initiated Diabetes Type 2
Oct 2016. Assigned Camp Atterbury (CAIN). VA Claims sent for all conditions, referred for Diabetes
Oct-Nov 2016. C&P Exams. (Hearing, Respiratory and Physical)
Nov 2016. Sleep Study complete, turned in to VA. VA credits Sleep Apnea condition.
Feb 2017. Received DA3947 and signed, CAIN Soldier Counsel said to sign that I have no appeal even though reading through my C&P Exam/NARSUM/DA3947 has mistakes and misdiagnosis. Counsel said to appeal at PEB to correct conditions from C&P exam.
May 2017. New condition diagnosed (Neurocardiogenic Syncope and Ischemia). Counsel and PEBLO says no way to add new claim since it wasn't originally claimed. VA MSC said to add it after I am medically retired.
July 8 2017. Day 158 with no DA 199.
July 18 2017. Received DA199/Proposed ratings from PEBLO assistant. DoD 40%/VA 80%. Disagreed
July 25 2017. Met Counsel in person. Didn't help with VARR and only wanted to focus on referred condition found for unfit, told I can't add new condition.
Aug 1 2017. Sent PEBLO PEB elections (disagree, doing appeal) and COAD packet sent
Aug 2 2017. Typed up own PEB appeal and VARR request with documents sent to PEBLO. Added request for PEB to disenroll case and reenroll with new case file and send case back to MEB for updating conditions now that C&P exams are over 6 months and worsening.
Aug 3 2017. Legal Counsel read my self reported PEB and VARR appeals. He apologized for misunderstanding and will now type up PEB legally. And he also quit. New legal appointed.
Sep 29 2017. Depression, Anxiety and PTSD diagnosed.
Oct 5 2017. New Legal has PEB appeal ready for formal board.
Nov 3 2017. Formal board date to DC is Dec 6.
Update March 3 2018. To date my PEB lawyer called me and told me that the PEB agreed to send my case back to the MEB for review of a new condition that began soon after the MEB was complete.
May 2018. PEB found Neurocardiogenic Syncope/Heart Ischemia as unfit and sent to DRAS for Ratings.
July 2018. PEB Counsel and PEBLO send me new DA199-1. Shows they didn't re-enroll case and added Neurocardiogenic Syncope to Unfit: 10%. DRAS coded it as a Ear disorder instead of my diagnosed Ischemic Heart Disease/CAD. Wow!
August 2018. VARR came back. Success! Changed Neurocardiogenic Syncope to 20% using the Epilepsy Code. Now at 50% DoD and 90% VA. Signed DA199-#2 Agreed with PEB.
September 5th 2018. PDA called me, they are processing case.
September 10th 2018. PDIR is complete and posted. Medical Retirement December 09 2018! 50% DoD -90% VA, PDRL
March 2020. Filed new claim, skin: Herpes Simplex, Herpes Zoster, Puritius. March 2021: VA 100% P&T!
