Hi,
Thank you for taking the time to read my post. My MEB packet has just been completed. I do not agree with my referring conditions. I need help to understand if this is something I can dispute, and how.
My initial meeting with the PEBLO there was an immediate red flag on my paper. I was referred for behavioral health. I expressed my concern to my PEBLO, sighting that I had Chrons, fibromyalgia, and migraines. That I wanted these conditions evaluated as well for consideration as other referring conditions. I was told that they would look at everything.

Today I was notified that my only refereeing conditions where depression, and PTSD. I was flabbergasted. I called my PEBLO. He explained that while yes, the army found that I had every condition I listed, that they would have retained me if I alone had Chrons, fibromyalgia and migraines. He said they would be evaluated by the VA, just not the army.

I looked in AR 40-501 (the reg they sighted) and found every condition there. Not to mention, the conditions criteria (severity) matches what it says in AR 40-501. It also matches what was said in the NARSUM. I understand that these conditions will be rated by the VA. However, I feel a disservice is being done and I can not understand why. My conditions meet the criteria to be medically discharged per AR-40-501. The reasoning on the NARSUM is that those conditions did not impede me doing my MOS (42A).

What is the true difference between referring me for PTSD & depression, versus referring me for all my conditions that individually, by themselves meet MEB referral standards?

Shall I let sleeping dogs lay and except what they have decided? Although, it is not the truth.

If I wanted to disagree how would I do that?

How long does this prolong my process? Everyday, coming to this instillation gets worse and worse. I'm not sure how much longer I can do this.

Any guidance, knowledge would be so helpful.

Thank you for your time.

A referred condition is one that your PCM or Specialist has determined potentially unfit for service.

If a doctor did not submit a MEB for the other conditions you listed, they would be considered fit for service just for the fact that they were not referred to a MEB.

The VA will rate ALL your conditions for later compensation after active duty. The Army, however, will only consider what condition(s) you were referred for (if I understand correctly you said Depression and PTSD), determine a fit or unfit through the MEB/PEB process, then use the VA rating for those conditions to assign you a DoD percentage if found unfit.

To disagree, the doctor(s) treating for the other conditions would have to first agree that you should be med boarded for those conditions. Then they would add an addendum to your other MEB condition.

It depends on where you are in the process as to whether or not it can still be done.

DoD must consider all conditions. If you have an unfitting condition that the IPEB does not rate; then you request a FPEB.

Informal Physical Evaluation Board - it is a paperwork drill

Formal PEB- you appear with counsel appointed by the service if requested or you can hire private counsel.
