SSDI ALJ Hearing

After the 3rd ALJ hearing, I have once again been denied. Can't handle this shit anymore. Two govnerment agencies cannot come even agree on one seemingly simple thing. Exhausted all medical possibilities at the VA, for my condition. So, I guess I am fucked, because of bias, on the part of the ALJ. So fuck me.

So, I just recently went to my hearing at our local ODAR office, and had an attorney represent me, as my case is somewhat complex. All went well during the hearing, however, the judge opted not to ask me any questions, and let the representative do all of the questioning. The hearing wrapped up inside of thirty minutes, and I my treating physician at the VA, as well as an IME both say I am not able to work.

Just the other day, my I received the Judge's decision in the mail, and when I read it, he gave me an Unfavorable decision. Reading into the details, it seems that the Social Security Office requested an RFC from a physician that has never seen me before or treated me, with in the VA system, and they used this to great weight in their decision instead of my treating physician. Which, my treating physician would have more experience, and knowledge concerning my disabilities, than a physician that has never treated me before.

I can speak to this, from recent experience, the system is set up in a box, and if your disabilities can not be put into this box, then the SSA feels that the SM is capable of performing work. Even though, a SM like myself, has been rated by the VA, to be unemployable due to my disabilities.
I'm very sorry to hear your outcome. I believe in the power of prayer. I graduated from a Christain University. I said that brother because I am a peculiar SM. I may see things different. Yes, the ADJ decided against you and a Doctor rendered a decision based on record of his opinion without consulting your doctor. This was wrong to me but within a gray area of the law. Your lawyer knows that it takes only one condition to receive the SSDI. Fibromyalgia consist of several injuries all rapped into one look at the 38 CFR and find you injuries your injuries must affect your working ability. Find a new injury that conflicts with the others and this injury makes you disable. From the start this begin a new case in which can be a new outcome of anxieties head aches back pain with sciatica, knee issues arthritis in the hand etc. Bless you brother!

So, it has been awhile since I have touched this thread. If you are reading this, and expecting some type of positive re-enforcement, or outcome, you just might want to find your way to another thread. Because, I am about to drop some bombs that you may not want to read or hear.

FUCK the Social Security process!!!!! I am not sure I can be more clear than that. Oh wait, I can, because I don't cower to some bitch of a judge, who thinks he/she is doing America a service, by being a god damn gatekeeper to a trust fund that is meant to provide for the disabled!

Now, I don't know of a single one of us, who had any intent on becoming disabled due to military service. We pick up our rifles, put on our gear, and carry out the orders of our superiors, with out question. Yet, when we come home from our different deployments, and are honorably discharged/retired due to injuries received beyond our control, and the treatments modern medicine, is currently capable of, fall short of making any of us whole, from the fucking injuries, I or anyone else sustained.

So, when any of us, truly try to work with our physicians, and retain bit of a life, prior to the injuries. These sycophant judges, take pride in watch us, grovel for help, in front of them. They want to see us cry, and be battered, beaten, and broken beyond reproach. But, I won't give them the FUCK'n satisfaction they crave. None of us, should give them that satisfaction. Dignity, Loyalty, Respect, Selfless Service, are just a few of the values instilled in a Solider.

And, these pukes, at Social Security, deserve none of the respect, or dignity, that I would give a fellow service member. They don't even deserve to live within the borders of the nation we would give our lives to defend. I don't know a fucking decent person at the Social Security office, and I am will to bet that the following quote out of FMJ sums up, how they treat people, as a whole, "I bet you're the kind of guy that would fuck a person in the ass and not even have the goddamn common courtesy to give him a reach-around."

But, hell I am not quite done, this is just the tip of my cock beginning to be shoved up their tight ass. So, "what is your malfunction, numbnuts? Didn't Mommy and Daddy show you enough attention when you were a child?" Why the rant? Because, after having 3 separate ALJ hearings, and having my case sent to the Appeals Council 3 separate times, because the ALJ choose not to follow the special instructions submitted to him by the Appeals Judges. On the 3rd Appeals Council submission, an Administrative Officer, felt the case did not warrant review. Even-though the case had be remanded two previous times, for the ALJ not following instructions from the Appeals Council. So, yeah, Fuck the system, that is trying to fuck me.

Social Security may want to to feel like Private Pyle, from FMJ. "Oh that's right, Private Pyle, don't make any fucking effort to get to the top of the fucking obstacle. If God would have wanted you up there he would have miracled your ass up there by now, wouldn't he?" But, if that is the case, they will have a whole lot of "Seven-six-two millimeter. Full metal jacket," because that is how Private Pyle went out.
