Take % or fight?

After a long wait, I got my PEB results.

I had 3 unfits:

Back: 40%
Neck: 20%
Neuro related: 0%. They claim because it’s well medicated and not causing issues. Though I disagree. I’m fortunate finally got meds to control it. It was deemed possibly hereditary. Though I call BS, blame gulf war syndrome. But do say army aggravated it.

I have 15 years and I’m BRS and an army reservist with 8yrs of active time with a career, ready for my return lol. Is it worth a big fight, or take the money and run.

Also got 90% VA after this PEB. I have 50% from when left active. I assume they haven’t combined them yet.

Given your 15 years of service, being in the Blended Retirement System, and having 8 years of active duty, it’s essential to weigh the potential benefits against the stress and time of a prolonged fight. If your current situation is manageable and you feel financially secure, it might be pragmatic to “take the money and run.” However, if you believe there’s a strong case and you have the resources and patience to pursue it, fighting for a higher rating could be worthwhile. Especially given the compensation difference from 90% to 100%

Just not sure what 60-70% DoD gains me really as 15yr BRS officer. The BRS in itself is confusing for medical retirement.

Though thankfully I do have a solid civilian career with a better retirement.

Yes its worth it. My wife did a VARR to go from 80% DOD to 90% DOD even though she maxed DOD% at 75%. By raising the condition it made her VA total rating go up from 90% to 100%. That was much easier to do via a VARR then to wait to get out to appeal.

My previous VA %, what happens to that. Do they put your proposed from PEB in with that post discharge? The VA is such a mystical place
 
Sorry didn’t explain that well. I have 50% VA of items NOT evaluated again and brought into the PEB evals. Because didn’t want to mess with those standing percentages from the past

Did you choose LDES or IDES?
 
Nice. People often get scared and choose LDES losing a lot of rights they could have had to fix things if things don't go their way. Any condition claimed will be rated again unless you specify in IDES you only want conditions rated for the purposes of DOD. I don't believe you can pick and choose.

Any conditions that are unfitting you can immediately challenge in the process via VARR if you believe the % is wrong. For any other conditions they will rate them again.

Now if you didn't list conditions that are already rated than I assume those conditions aren't affected one way or the other assuming they are VA ratings and those conditions aren't any of the unfitting (s) that the DOD is rating for the purposes of medical separation or retirement.

Are you talking about the whole proposed rating vs. final rating thing for the non un-fitting conditions?

I am hoping my proposed rating is where I think it should be but I have been submitting extra documents via quick submit just in case.

I'm curious how the proposed rating will look in terms of evidence reviewed vs. the final rating after I get out.

Maybe I am confused. Are you a Reservist or Guardsmand with a VA ratings already and now are in IDES where you will be re-rated by the VA?
