public law disability 97-253, that’s what we fall under as military techs. Once you start getting interim payments, that means your almost done with your close to being done with your DR process. Your process was faster than most of us on here. It took a while to get my CSA number

Yes, I was able to get a 90 day extension back in May. So my last day in pay status will be August 12. Then I’ll be LWOP until claim is adjudicated. That’s good to know, I did not receive a letter of denial yet for regular retirement. I heard your supposed to get that at some point.
Yes you will, I got my denial in May 31 and got my interim pay letter Jun 28 with 3 months back pay, but they still owe me 2 months back pay.

Np any time. Jmc81 is really good with this stuff too. Hope your VA rating is high, also if you can get CRSC apply for it, it’s tax free money. Good luck brother.

I’m at 90 VA, would have been 100 but VA reduced my 50 percent migraines to 30, even though that referred condition was just rated at 50 a month ago lol. I talked to vfw in Seattle and she said she will hold an informal conference with the rater to fix it. I did apply for CRSC June 09 but still waiting on that too. If you or anyone need any help with VA tips, I’d be more than happy to help. I’ve been through the ringer with them since I left AD in 2017.

That’s crazy, well bro your set then. I’m 100 VA, 70 in CRSC and almost done with the OPM DR. I just got back from Seattle last week, I’m from Houston and saw a game at T mobile park, it’s nice out there

Nice man, congratulations! Yea Seattle use to be a lot nicer! Houston, nice! I was at Fort Hood 06-09 then pcs’d to JBLM. I like TX!

Everything jesusej19 is right on the money. After you are denied seems like month later you get approved and few weeks later intriem pay starts. My DR has not been going through good I never received intriem pay and it at a stand still with no answers. Mine may have fallen though the cracks but yours is off to a good start. I received my CSA in January.

Dang man, sorry to hear that. Hopefully your DR gets processed soon. Have you thought about filing an appeal? I read a article about some DR claims taking too long, and if it happens you can file an appeal-If a decision takes too long, you may have a right to appeal. Failure to respond is essentially a constructive denial that you can appeal. Here is the link to article. I wish you the best of luck. So I received paperwork from OPM health insurance specialist asking if I'd like to keep the same insurance plan I had and make it retroactive to February 7 when I lost it or start in this month August. It also had an option if I wanted to cancel/suspend, if I take that option I can never use insurance through Fers again! I emailed once I'm fully retired can I change insurance at open enrollment or suspend my insurance and use other insurance. The specialist said I can make changes in open enrollment time. I can only suspend insurance due to Medicare or Tricare. So when I have to keep my insurance until I start my military retirement. My case is being finalized first check is in September for the month of August. I never did receive an approval letter or intriem pay. Maybe the Congressional inquiry helped move it. No mention of back pay either but I didn't ask. I find it unusual that while I worked I could choose not to use the insurance and come back another year and use it but I can't do that while being retired. But very thankful that there is progress.

No don't have that either, think my DR is not going the way they usually go. If what they say is true from the time I submitted my paperwork for DR with my HR to finalization should be 10 months.

I thought it would be denial of “regular retirement “ but it says “disability retirement under the regular provisions of CSRC or FERS. The last paragraph reads in bold underlined words “ DR under PL-253 special provisions “.


April 27- submitted memorandum for 90 day extension to HRO for current position (approved) new thru date 12 August

May 03- met with HRO and submitted disability retirement packet

June 14- received CSA number from OPM

July 26- called OPM retirement center for status update, they said “ it is currently being reviewed by a medical specialist and could take 2 weeks “.

July 30- SSDI claim denied( submitted April 26)

July 27- letter of denial for disability retirement under regular provisions of CSRS or FERS.

That seems right they denied the normal DR now it will be processed as the special provisions. I was under the impression if you meet the time age requirements for early retirement it went that way over DR but don't quote me on that. I would think your HR would have told you if you were going to take early retirement over DR.

No, I definitely wouldn’t qualify for the early retirement. Based off of what my HR told me and what you guys have said about denial letter, this looks like the letter. Now I have to send to HR so they can resubmit under PL 97-253.

Hey ruugedsapper86, when I got that letter I called the guy that was in charge of my case too, and he was on top of it, he told me that he had received it also. What branch are you ?

Can someone provide the source or regulation stating " Military Reserve Technicians must be at least 50 years of age and serve 20 dual status years or any age and have served 25 years as a dual status technician (no military buy back) in order to receive an annuity? HRO seems to think military buy back counts for MRT's to receive DSR retirement and not allow for a Disability retirement.

Are you getting medically separated ? And how old are you ?
