Combat related won't be recouped either. Combat related is more broad than it sounds.
Combat Action - Contact with the enemy
Simulating War - Training events, note a ruck march won't count, but a tactical road march would, it has to be an event specific to a war time mission
Hazardous Duty - Flight duty, jump status, something like that. Generally has to be a non-routine type.
Instrumentality of War - A piece of equipment that is specific to the military causes the injury, such as a tank rolls over your foot.
If you were found 70% through DoD and 100% through the VA; if you were to submit to the BCMR to request that the DoD rating be 100% based on unemployability is there any risk/chance that the BCMR could lower your 70% rating - or would it be a "you have nothing to lose" by asking sort of scenario?
I'm in the same boat and I was wondering if there was any risk in a BCMR lowering a previous PDRL rating decision?
That is very good information for anyone that is considering applying! If I could shout it out from the rooftops of this forum I would. I know the Formal PEB is a different story.
I guess my main concern was future BCMR/BCNR changing or lowering previous BCMR/BCNR ratings. They have extensive power to alter records and I didn't know if they have ever tried to do such a thing to a servicemember. I know PDRL ratings are permanent unlike most VA ratings but the BCMR/BCNR's have incredible power and I didn't know if there was anything stopping them from altering one of their previous decisions.
