I have 1300 being taken out of my retirement pay titled VA waiver. dfas gave me 2 different answers one guy said everyone has that and it’s not because i was meb’d the other lady said it’s like a penalty because you were meb’d. i did over 20 years but i’m on the tdlr. i’m 70 tdlr and 100 pt. anyone else have a va waiver on their retirement les

If you are receiving CRDP, the amount is shown on page 2 on your DFAS RAS.

I suspect:

1. Your retired pay is computed at 70% x average high three base pay
2. You retired pay is reduced by the amount of the VA compensation
3. CRDP will restore the longevity portion of your retired pay (i.e., AD or AD equivalent x 2.5% =longevity multiplier; average high three x longevity multiplier = longevity amount of retired pay. Note: 2% is used for blended retired program folks.
4. It appears, without seeing the RAS or having other details, that the negative 1300 is the amount of waived retired pay in excess of the longevity amount.

5. Recently, I asked DFAS about a case on this board that involves REUX. I was sent a copy and paste reply that had nothing to do with the elements of my question.

CRDP info:
Under these rules, you may be entitled to CRDP if…

  • you are a regular retiree with a VA disability rating of 50 percent or greater.
  • you are a reserve retiree with 20 qualifying years of service, who has a VA disability rating of 50 percent or greater and who has reached retirement age. (In most cases the retirement age for reservists is 60, but certain reserve retirees may be eligible before they turn 60. If you are a member of the Ready Reserve, your retirement age can be reduced below age 60 by three months for each 90 days of active service you have performed during a fiscal year.)
  • you are retired under Temporary Early Retirement Act (TERA) and have a VA disability rating of 50 percent or greater.
  • you are a disability retiree who earned entitlement to retired pay under any provision of law other than solely by disability, and you have a VA disability rating of 50 percent or greater. You might become eligible for CRDP at the time you would have become eligible for retired pay.

Thank you Ron! I had my TDlR mental health review on the 2nd of December still pending results i hope they perm retire me and leave my rates alone. I contacted afpc and they said both my rates could change my VA and dod rating and both could change my pay.
