Am I entitled to disability compensation pay from the army?
PEB rating 40%
VA rating 90%
18 years in Gational Guard (accumulates to about 7 years of active duty)
I am being medically retired for conditions caused by my deployment time to Iraq. I did not engage in a firefight, I was BDE Staff (S6 NCOIC) so I stayed inside the wire. We were repeatedly fired upon with rockets/mortars (more than 30 nights of this). I was not in the vicinity to feel the blast or explosion. Merely to see, hear, and smell it.
I understand that my VA disability pay is much more than Army disability. But, if I weren't getting VA disability right now, would I be entitled to Army disability compensation right now (I am less than 40 yrs old)? That is the big factor in how I move forward with the PEB (appeal or not).
If I didn't address anything, please let me know.
