Was he also oconus?I got medically retired and I'm Oconus, I’m sure that plays a factor. My buddy who got retired said it took him 6 weeks to get an EAS.
If you happen to know. what was the date he signed his findings and what was his EAS? I'm trying very hard to guestimate what the actual date of my EAS will be, I really need to be gone by March 30th or the beginning of April and I will only have 15-17 leave days at that point. He was conus. Medically separation is easier to have orders for than retirement because you rate PTAD and other benefits.
Your disability severance is an advance of your VA payments. If your severance check is 1000 dollars and your VA percentage pays you 100/month, it will take ten months for you to start seeing the VA payments. This is the post tax amount btw. The VA payments will start once they would equal the severance after it is taxed.Anyone have an idea of how long it takes for VA pay to start? EAs was NOV 1 still no VA compensation.
No EAS still, I will update when i get them@assmilk still no orders from me yet? How’s your end?
MMSR4 told me today that they think I will get my "index" sent to them from the PEB any day this week and once they receive it, my EAS will populate two days later. Also told me that if I wanted a specific EAS date since I am retiring I can request it and he told me to email them formally requesting a certain EAS date. (He said I need to do that NOW before they get my index).@assmilk still no orders from me yet? How’s your end?
They said if I do get my index sent from the PEB to them that they see my EAS being April 10th. I requested March 31 and I will definitely put here after I see how all that shit goes.MMSR4 told me today that they think I will get my "index" sent to them from the PEB any day this week and once they receive it, my EAS will populate two days later. I was told that they only pull money from your referred conditions. So they will only be pulling money from the conditions that got you separated from the military, meaning if you're over 20% on your VA you still get the money for your other conditions. Not sure if this is correct as I keep seeing people say what you're saying and that they take the whole thing. Did you see this in writing somewhere?Your disability severance is an advance of your VA payments. I just finished my last C&P exam and have done countless hours of research into this whole process. A severance check is nice, mine would come out to over 90k but that is all money we will be paid anyway. That being said, you all have made so many phone calls and learned the process, with where I am at, how can I speed it up in anyway?
As far as speeding things up keeping good communication and signing your stuff and moving it along as quickly as possible is about all you can do. You're kind of at the mercy of people doing their jobs.I was told that they only pull money from your referred conditions. Did you send out that email yourself or did you have your S1 send it?MMSR4 told me today that they think I will get my "index" sent to them from the PEB any day this week and once they receive it, my EAS will populate two days later. Coming here to provide on update on this. Got an email response stating, "we cannot do that". Then 25 minutes later the LCpl emailed me again and basically stated that his Gunny "the one I spoke to on the phone" told him to put my name down for that date. I emailed them myself; I don't know if I didn't have to get my S1 to email to email them because I asked about it BEFORE they actually gave me an EAS or not, but I did not and was not instructed to have my S1 email MMSR4.Did you send out that email yourself or did you have your S1 send it?
Per the VA: "Once VA determines recoupment of separation benefits is necessary and the amount that is subject to recoupment, it must withhold some or all of the Veteran’s monthly compensation until recoupment is complete."I was told that they only pull money from your referred conditions. You’re actually wrong about this. Here is the way it works…Per the VA: "Once VA determines recoupment of separation benefits is necessary and the amount that is subject to recoupment, it must withhold some or all of the Veteran’s monthly compensation until recoupment is complete."
Per a legal site: "Generally, severance pay must be repaid before members can begin receiving VA disability compensation. However, severance pay for a disability incurred while serving in a combat zone does not have to be repaid."
The amount subject to recoupment is the post-tax amount. The only time they do not take the severance pay is when you rate Combat-Related Special Compensation (CRSC). Sucks since there will not be a steady income until it is paid back but the lump sum can help in a lot of ways. There are pros and cons.
What was your timeline like? My case has been a complete disaster and lack of communication… just trying to find someone with recent findings to see if I’m anywhere near findings. For reference: my VA findings were posted on the Va website as “finalized” on 08 Jan.MMSR4 told me today that they think I will get my "index" sent to them from the PEB any day this week and once they receive it, my EAS will populate two days later. When I spoke to MMSR4 last Thursday they received batches up to 50, I’m 56. When I spoke to the LCpl and civilian yesterday they said that they haven’t been receiving anything since February 8. I called the PEB and they said that we are getting the run around and someone at MMSR4 isn’t doing their job because they have been sending the index’s.Coming here to provide on update on this. Got an email response stating, "we cannot do that". This was the response I got from MMSR4:
"My GySgt informed me that you and he spoke about getting 20240331 as your new EAS date. I will put your name down and keep a look out for your index, please monitor your EAS change." --> I do not know if this 100% solidified March 31st as my EAS date but that it what it sounds like.
MMSR4 also stated this:
"There is no specific day of the week that we get our index batches (index is the shit that the PEB sends out to MMSR4 so that they can give you a new EAS, apparently the PEB sends them out in batches and once MMSR4 gets them, it takes 48 hours to have your EAS populate). I spoke with my OIC about this, and he is already contacting the PEB to see what is going on." --> Idk if he is referring to only looking into my index or if they haven't gotten a batch when they usually should have.
Are you talking about your VA claim closing or your direct findings coming in from the PEB? These are two different things. What was your timeline like?
