MEB vs Chapter

I had a family care plan counseling initiated on me giving me 30 days to complete or I would get chaptered under -5. Well I just got a meb started on me but my commander is saying that I have to complete my family care plan or I will still be chaptered. Can they do this to me? All they have on me is the counseling and no chapter paperwork has been initiated. Does the meb take precedence over the chapter?
 
To my knowledge the only thing you can be chaptered for during an MEB is Chapter 14 (Misconduct). They can initiate chapters for other things but it will stop at BDE Legal and sit there. The only time that would even matter is if you are found fit, they could continue with the chapter. I think...Someone else probably will offer some concrete information for you.

Why is it a problem to complete a family care plan? Seems like it would be a routine task, and one in your family's best interest.

The problem is that there is no one I can trust/count on that is near by to be able to be part of my family care plan. And the amount of time that I get to be able to complete the family care plan it will not get done. out of the 30 days that I have to complete it I am in the field for at lest 20. So that is my issue. there is no way I'm going to be able to make the appropriate appointments to complete that family care plan. And you would have to understand my unit that they don't give a F*** about their soldiers or families. Welcome to 1-1 AD

Actually, you can be chaptered for anything while you're being medically boarded. But the medical board will take precedence over anything that doesn't carry the possibility of an UOTHC discharge. That would be misconduct as you stated, but it can also be fraudulent entry or court-martial.

I'm just going to be honest here. This is going to come out that you refused to follow orders and accomplish a regulation required action. A FCP is just required, period. Save yourself the hassle and figure out a way to swallow your pride and get it done! Once that is done you can move on with your MEB.

AEmedic has a good point. You seem to be making the hassle worse for yourself than need be. A FCP is for emergencies or times when you can't be there for your kids and family. With that in mind it should be something that you want to do to protect them. Just because you have a low opinion of your command is not a valid reason to blow it off. Don't cut your nose off to spite your face. Keep it in perspective, get it done, and move on with the MEB.
 
Not 100% positive i would just make up a bs family care plan. If found fit you may suddenly be expected to impliment it.

As stated before, it would be a dual procesd case, so if found fit they would chapter based off care plan, which may be best for you. There is a risk that if found fit the general will decide to chapter off family care instead of disability. I think that's unlikely, but definitely possible.

If it was me, i'd just make up a bs family care plan, but its not me risking possibly having to try to impliment it.
