That’s good news! I noticed mine says pending decision approval as well. Do you know what that means? What did it say before that? I’ve had my proposed rating since April. Does that mean PEB grabbed ratings from VA already?

Scratch that. Just talked to my new PEBLO. PEB has requested ratings from DRAS. Maybe that’s what decision approval means. IDK
 
just talked to my PEBLO in regards to taking leave (unit has an upcoming block leave) and she told me that her system shows my 199 is currently being typed. She seems confident that i should have my ratings in the next week or two. Fingers crossed
I started my MEB in October 2020. VA closed my claims in February and today I got my 199 finally...

Good stuff. Hopefully it was a good outcome since it took so long. I’m on week 10 and my packet was just submitted to VA DRAS to apply ratings. Probably got a hot minute until I see 199

They do appear to be very behind schedule. It sucks because I'm praying I'm out before January 2022 because my school program starts then, but it's looking less likely as the days go by. Just stay busy and time will pass by and youll have your next step complete before you know it.

You got your 199? You should be getting orders and out pretty soon. Definitely before 2022

I am appealing the DOD decision. I have a meeting with legal tomorrow and then they said I go right back to waiting like I did for my 199. The only timeline they can reference is my IDES dashboard that said Nov/Dec with an appeal and thats without using leave...I will have around 100 days saved up around Nov/Dec so I need to decide if I actually want to use it or not.

Yikes. I’m in for a lot of low back and severe radiculopathy too. Did they not add on your sciatica if you don’t mind me asking?

They did not add it. My only disqualifying issue was my lower back. I stopped going to appointments after my MEB that were specifically for my lower back and started making separate ones that were for lower back and another for radiculopathy. That was what legal told me to do as none of my medical records showed I went in for just radiating pain, but instead for lower back where I mentioned radiating pain. My QTC examiner rated me for bilateral radiculopathy and I got like 10% for each leg for that from the VA.

I wasn't able to appeal when my NARSUM first got back (was advised against it) due to the limited records on radiating pain alone so appealing to the PEB is going to be my first time.

So here’s a little insight to mine for you and possibly for future people as well. I was MEB for my lower back with DDD, DJD, IVDS from L2-S1(blown discs) SI Joint displacement/disfunction, pars defect, spondolosis. Whatever. I had mentioned leg pain from the start and got seen for it SEPERATELY a couple times. Got injections for nerves and gabapentin. But mostly seen for LBP with radiculopathy. When I got Narsum back legal mentioned that I needed to do an IMR and get Radiculopathy as a separate unfitting condition in block 2. So I did and everyone concurred and it was added seperately in block 2. Now the deciding factor was MRI evidence showing pinched nerve at L5-S1 Bilaterally but more severe on Left side (I only claimed left). So they cannot deny you having it as long as there is some medical evidence of you having it, even though you weren’t seen seperately for it. If you have an MRI showing the results it shouldn’t be a problem. If you mentioned it before then there is record. I think you will be fine but the waiting does suck. Cheers
 
got my 199 today, will be doing a rebuttal due to incomplete exams of my wrist(also fits into forearm for ratings) here is my current break down

Status Post ORIF right wrist 10% (can make a case for up to 50% with forearm testing)
tinnitus
10%
Back condition with spasms 10%
Right Knee Condition (10%?)
Left Ankle Condition 10%
Clicking Hip Syndrome - 10%
Left Shoulder Condition 20%
Right Shoulder Condition 20%
Mental Health 50%

ttl= 90%VA 10% Army

Can I ask If the 10 army was for your back? My back is the biggest part of my case so I wanted to ask.

Even if I get the possible 50% for my wrist/forearm it won't be enough to push va to 100 but Tricare

Yeah I wish I had been seen separately prior to the whole process. Legal went through my medical records and highlighted the appointments that I mentioned it prior to the MEB. I got a few people from my CoC to write statements for me on the times they've seen my legs give out at work. We submitted it today, so hopefully it doesn't take forever to come back.

The MRI shows bilateral bulging discs pushing into the recesses @ L4-L5, L5-S1. I complained SO much about the pain in my SI Joint since 2018 and EVERYONE ignored it. Even to this day I can make my left side SI Joint pop. They claimed nothing was wrong with it even after the MRI. I guess I made it up in my head or something. Your advice is spot on though. I really wish I knew it before starting this whole process.

army is rating me for my wrist, due to lack of rotation (therefore cant hold riffle)

Wait so did you just appeal the 199 and wait for them to make a decision on the appeal and they denied the appeal and scheduled an FPEB? Reason I am asking is because this Wednesday I submitted my appeal to the PEB and was wondering what to expect as far as a timeline goes.
 
Legal counsel advised me to go right to fpeb as a " stalling" tactic so I can get my PCM to provide more documentation

I am jealous!! Still waiting for my FPEB date. I guess I will plan for mid Aug, based on how close or timelines are. Thanks for continuing to post updates!
