Carson Timeline

Congrats on your results and your journey throughout the process. I am also Army and I just started my journey
I’m referred for both knees but I have anxiety and depression disorders but wasn’t referred for that. However what were you referred for? If you don’t mind me asking?
I was referred for my hip after having continued pain following surgery to repair torn labrum and FAI. I did a NARSUM rebuttal to have my knees included as I had multiple diagnosis for those as well but they wouldn't include them.

Okay I understand but that’s bad that they wouldn’t I hope you got it rated with the VA. And I will see how and if they’ll be able to add my other conditions in

Did they tell you when you’ll receive your DD214? Is it prior to starting leave?

Once you receive your clearing papers, there will be a DD214 appointment date on it. So you wanna make sure you clear everything both unit and post clearing prior to the DD214 appointment. You will not receive your dd214 if you are not done clearing. If for some reason, you can't complete clearing prior to your DD214 appointment, call them and they will reschedule you for another day.

As soon as IPEB find you unfit for duty, go ahead and talk to your supervisor about getting a Memo to clear CIF without orders from your commander, and then take it to CIF and let them clear you. This will safe you time when you receive clearing papers. Also, make sure to knock out SFL-TAP while you are going through the process.
This is exactly what I did when I was going through the process.
When I received my clearing papers, it took me 4 days to clear everything and receive my DD214 and went on PTDY leave. I'm still on PTDY leave as I speak.

how did you start with your rebuttal statement

One comment on this. Regardless of the results from submitting a rebuttal its not the end all be all. Its a start to state your case. It can help even if they don't agree or make any changes to the NARSUM. Then when you get your results from the IPEB you can check that you do not concur and that you request a FPEB. At the FPEB you can argue for the condition to be added as unfitting and it helps if you have been asserting throughout the process that its your contention that the condition should be added. So lets say the rebuttal doesn't lead to action. Now you can prepare knowing you are going to appeal to FPEB. You can get additional medical evidence, buddy letters and if your command is on board a letter from them too.

My lawyer went over the stuff I had issues with in my NARSUM and she wrote out the rebuttal for me. I knew that they likely wouldn't change anything given what my lawyer had told me, but it's basically setting it up for an FPEB by saying that you've disagreed the entire time and not just when you got ratings you didn't like.

My issue was that doing an FPEB would have meant it wouldn't start until May and I didn't want to wait that long so decided against it.

Yep! That is definitely the trade off! You will be in longer when you try to fight the results:)

Question, I just got my 199 and proposed va ratings, but my VA is still showing examining evidence phase. Doesn't the VA have to finish everything for the 199 to be fully done?

Nope because the VA technically doesn't finish until you get out and submit a DD214 to them. All the ratings that the VA does are only proposed at this point and used to help with getting your DOD ratings. Those ratings cannot be final until you are actually a veteran, which means you have to be out of the military.

Ok. So if I already have a VA rating and then this is a new claim with the IDES route they should be combined when the VA is done? I already had 80% VA, and now the proposed VA is 90% with increases from my previous claims. Doing the VA math on the Hill and Pont calculator it states I should be 100%, but I'm just confused on all of this.

If separate conditions then yes.

Some on this claim are increases from previous service-connections, and then the rest are new for this claim. I have three ratings for separate claims that didn't get applied to this home. Hopefully making sense. Thank you!

I was referred for continued pain in my left hip despite conservative treatment and surgery
