**Update** claim showing closed on VA.gov. Closed on 9 Aug so from what I have seen from other members means that ratings should come this week…hopefully
When did yours say updated? Mine says it was updated 10 August and was hoping it meant they would be done soon.

Updated last week not sure what day. I just spoke with my PEBLO that my ratings are in but he hasn’t received the 1180 yet. So now we are waiting on them to send it to us so I can sign it an FINALLY start out processing!

Spoke with my PEBLO today and my ratings are completed but we are waiting for the 1180 to be sent to us. 20% DOD and 100% VA…so guess now I get to go down the longer road and appeal. Anyone else gone through this recently and how was the process?

Sorry to hear that. Hopefully the appeal goes your way. There was a couple of people who went through the VAAR not long ago on these forums.

Left knee pain is what they put as my IDES referred condition. I feel that I should have had more added to my package than that for referred conditions because I walk with a cane most of the time and also have right knee and hip pain because of my issue. Im pretty sure none of that was taken into account for the DOD rating though

Did you happen to have surgery? That's exactly why I'm going through it, but it's my right knee w/ quad weakness. I had surgery Feb last year and I'm in more pain than before.

I did. Had 2 surgeries and my outcome was worse after. I have atrophy in my left thigh now and use a cane to walk around it sucks. Honestly its a slap in the face for 20% DOD rating. My PEBLO was fuming when she heard thats what I got so we are going to a FPEB now

I'm sorry to hear that.. I have some pretty bad atrophy, and my thigh still doesn't work and it just twitches. Couldn't count how many times I've fallen down my stairs, because of it giving out. I'll let you know what my outcome is considering ours are pretty similar. Best of luck at the FPEB and hopefully you can get pushed pass that 30% threshold!

Best of luck to you as well. My best advice is make sure in your package your referred condition is not limited to just your knee like they did mine. Make sure the thigh issues and other disqualifying conditions are in there too. I think thats where my package was messed up. Im going to have those conditions added which should put me over the 30%

Yep took the $100k…well a little more than that. I already own a small used car dealership so now it about to be a BIG one. Wife has insurance options through her job plus im 100% disabled so lots of healthcare options for me.

If we didn’t have the ability to get private insurance or I wasn’t 100% I would have proceeded with the FPEB but after discussing with my wife this was best for our situation.

Ya waiting really sucks but depending on your situation prepare for both outcomes whether it’s separation or retirement. That way when you get the results you can execute that plan. Saves you from being blindsided.
 
Has anyone heard about new legislation stating if you are 100% disabled they would not recoup the severance pay? My VA rep said he had to do some more research but said he had 3 members all 100% disabled say they are not having their severance pay recouped. Anyone know or heard about this?




Also was digging through Financial Managment Regulations (I know fun right). Ill put in Bold what I found.

DoD 7000.14-R Financial Management Regulation Volume 7A, Chapter 35

5.4 Taxability and Withholding

5.4.1. General. Disability severance pay is normally taxable income. However, it is not subject to tax withholding or reporting if at least one of the following two conditions exists:

5.4.1.1. The entitlement resulted from combat-related injury or illness, as determined by the Secretary of the Military Department concerned, which happens as a result of any of the following activities:

5.4.1.1.1. As a direct result of armed conflict;

5.4.1.1.2. While performing extra-hazardous service, even if the service does not directly involve combat;
training; or

5.4.1.1.3. Under conditions simulating war, including maneuvers or

5.4.1.1.4. By an instrumentality of war, such as weapons; or

5.4.1.2. The member is entitled to disability compensation as determined by the VA or has received a proposed disability rating from the VA at the time of separation through the Integrated Disability Evaluation System.

So does that mean because I received a VA rating my DWSP does not count as income and is not taxable? DFAS should give me the full amount then correct? Anyone else recently go through this?
 
If you are 100% VA disabled still after removing the VA rating that was for your unfitting condition there won't be recoupment.

Appreciate you. Yes that will be the case with me. The IPEB determined that my IDES referred condition was my only unfitting one. Since I received the following percentages from the VA. For obvious reasons I dont want to disclose my specific conditions so we will just number them 1- 44.

Separated officially on 20 Sept. Received final paycheck 23 Sept.

Finance told me I should receive my Severance Pay within 20 days of receiving my final paycheck. Im currently at day 22 and have not received it. Has anyone recently received theirs? How long does it take to receive it? Im considering trying to call DFAS to check the status
