I applied for unemployment and I was denied. The reason for denial is " Ability-Under Care of Doctor' and the doctor has not release me for work. Also, I'm enrolled for college at night because I really hate the crowd. Thanks..

I think SSA is saying you have residual functional capacity (RFC) and that you are under care of one or more doctors. Unlike the VA, with SSA, its all or nothing regarding earning capacity.

If you plan to appeal you should consider getting an attorney. If not, you will at least need a medical opinion that differs from the SSA's opinion. Have you doc complete a separate RFC (see link below to form).

Are you talking about the SSDI? This is for monthly unemployment while looking for work although I applied for SSDI early this month chaplaincharlie.

Could it be? I applied for my SSDI early August and saw something in there? I know I can't collect SSDI and unemployment at the same time?

You can't collect unemployment unless able and willing to work. Each state has their own rules, but that's universal as far as I know. The info they have shows that you can't work, i.e. the doctor said you can't, so unemployment is not appropriate. You could argue with them that yes, indeed you can work and have been applying, but that contradicts what you are telling SSDI and doesn't sound like a wise course.

The only reason I applied for unemployment benefits because I know I gave taxes and I will meet the criteria to collect benefits. My condition is the reason I lost a job and I was hoping they will consider that you know. But how come nobody told me that I'm not allowed to work or seek work outside? Thanks.

They just have different criteria for insurance coverage. Sure you paid taxes into it, but you pay your home owner/renter insurance and you pay for your car insurance too. That doesn't mean you get to file a claim for both if you get into a car accident. Different policies are different.

The only problem is you misunderstood the criteria for unemployment insurance coverage. Most know that the coverage doesn't happen unless you lose your job without fault. Most understand that you have to be willing to work (i.e. send out resumes and apply for jobs). Most just don't think about the rule that you have to actually be able to work, but really, why apply for a job you can't do. Or maybe you misunderstood the rules for SSDI. SSDI isn't for if you lost a job due to disabilities, its for if you can't do any jobs due to your disabilities. Either way, applying for both suggests something with the story is off or needs some careful explaining to the people making the decisions. I have heard of people who have successfully applied for both, but I doubt its due to well reasoned arguments, but rather administrative errors, and some have gotten bills from the government when found out.

I applied for unemployment because I was not fired or quit but lost a job due to medical condition and hoping they will consider that. I applied for SSDI because my condition warrants that I can't be employed because of my disabilities. I know I must be active to look for jobs but I was upfront about my situation to unemployment officer that I have these conditions. The only thing I did not know was, I'm not even allowed to get a job because the doctors have not sign off on something..
