C and P exam and found errors

Hi,

I am currently going through the MEB process and completed my C&P exam two weeks ago.

The examiner was pretty nice, but one thing I was worried about is that he did not use the goniometer at all.

He asked if I had any pain, and I said yes, providing a pain level of 5,6,7.

Today, I checked my DBQ, and he marked a normal range of motion on everything ( shoulder, elbow, back, knee) ( he wrote pain level tho)

He also stated that he used the goniometer, which is not true.

Will I still receive a rating since I have pain?

should I file a complaint about this?

I am very frustrated and don't know what I am supposed to do at this moment.

Any comment would be appreciated.

Yes. Start with reaching out to the contractor to see if a new exam can be done. Next if they don't redo the exam you can ask your doctor to fill out a new DBQ and to include the use of a goniometer and then upload to the VA so that it can get corrected now instead of having to do a VARR later.

There’s a specific form you sign when they’re using the tool as well, at the exam. As long as they didn’t submit that with a weird signature, then it should be easy to do what provis said.
