DOD 10% VA 90% Going to FPEB

Signed my DA 199 denying the results to go to FPEB on March 14th 2015, When should I expect a FPEB Hearing Date? its been over 3 weeks.
 
Check with your PEBLO, the norm is your FPEB can be a month out from the date of you signed DA 199.

However, the notification (email and phone call from PEBLO) telling you will be having an FPEB should've been a day or 2 after signing your DA 199. Sometimes, the PEBLO send the notification to your military email and forget to give you a call.

Stay proactive with your case and stay one step ahead.

I have been on top of it and calling my peblo and she says nothing yet every other day I email and call and nothing I was wondering if the FPEB is really backed up because I signed my DA 199 requesting an FPEB and almost a month later still nothing... Its kind of driving me crazy but hey im still in the Navy!
 
The FPEB norm I mentioned earlier was Army. I thought you were Army when I saw DA 199. Hopefully some of our Navy buddies will chime in & share their FPEB experience.

Make sure you are prepared to show how the conditions which weren't found to be unfitting prevented you from performing your duties. Realize that the FPEB will be looking at your performance evaluations, MEB, and commander's statement.
 
Lower back pain but I have a few other things that should help my case.. and whats really screwy is that they just called it lower back pain when my back if really jacked up!
 
Be prepared to argue that other conditions are unfitting and demonstrate why. Did the PEB state why the others were not unfitting?

Mike, two of the three things that I was boarded for was found unfitting but I was only given 10% for one of them the other one didn't have anything why it wasn't rated but the third said it wasn't considered unfitting.
 
They are required to address the fitness impact of all your condition regardless if they were referred or not.

my reconsideration came back and they actually took something away. Didn't lower my 10% but didn't go as planned I Don't think im going to go to Washington DC to fight this......... Something about my VA doctors notes didn't coincide with my Out in Town doctors notes. The VA said I have migraines 3-5 times a month and My Nuero Doc says its 3-5 times a week Which it is , why are they going with what the VA said instead of what the Doctor I see monthly says!?!?!?! UUGH So frusterating
 
1 a month is enough for 30%. 3-5 and month or 12-20, both are equally eligible for 50%. The 50% requires the RO's interpretation of the vague "completely prostrating" and "severe economic inadaptability".

My guess is the migraines being fit means they aren't meeting the economic factor. I think that's the wrong standard, makes 50% migraines and IU for migraines virtually the same.
 
They didn't rate me for migraines they stated "Head aches" witch really screwed me over because I have been going to a nuerologist for years for migraines
 
signed my formal reconsideration findings today I guess I have to be happy with 10% dod :( really think I got screwed over, I will put in a VA reconsideration after I get discharged.. At least I am leaving with an honorable discharge !! :)
 
I would have gone to a formal and requesting a VA reconsideration while still in. What is there to lose?

Mr. Parker, Im in a similar boat as the above. Multiple ER and sick call visits w/quarters given, multiple meds tried and currently taking, log kept, and most importantly dbq completed by my neurologist stating 2-4 per week prostrating. I was rated at 0%, as the examiner put down •less frequent attacks. Big difference between my medical records and neurologist dbq. The examiner did the same with my documentation and medications regarding my asthma rated 10%. Records clearly show a defined history of FEV-1 in the 56-70 and both daily inhalational bronchodilator and anti-inflammatory meds. Thats in the 30% by their definitions.
 
I had a five year battle with the VA to properly rate all my conditions. It took persistence. Align the medical records with the rating criteria. It appears that in the development process of my BVA case, the BVA made the RO address the issues and questions of my appeal which led to the appropriate ratings without actually having a BVA hearing.
